ILR for UK Born Child Query

Post by cheescake25 » Mon Jul 27, 2015 4:15 pm

Hi,

My time line:

Tier 1 general received 08/04/2011
Tier 1 General (Extension) received on 25/03/2013 (PEO)

I am going to apply for my ILR in March 2016 for myself and my wife who is my dependent. I have a query regarding my daughter.

My daughter was born in the UK in Dec 2012 and currently she is an Indian passport holder. We had applied for her dependent visa at the time of our extension as she had to travel to India at that point of time.

Now my query is:

1) Can I just leave my daughter out of the ILR process and directly apply for her naturalisation using MN1 form once we get our ILR?
2) If yes, Do I need to apply for her naturalisation before my daughter’s current leave expires?

Please advise?

1. Yes and it is REGISTRATION for children. Adults are naturalised.

2. No, you can apply when you are ready. If visa is expired, child obviously cannot travel.
