ILR FROM TIER 1 route

Post by Sshahkhan » Thu Mar 10, 2016 9:28 pm

Hi I m applying for ILR from tier1 and need help to fill up the form.

6.1 what did you ( the main applicant) first enter in UK. This refer to the date of your first entry into the UK at the beginning of the period of stay on which this application is based.

Look my application is based on Tier 1 and I got T1 in 2011. What you think should I put 2006 when I came here or 2012 when I got this visa.

Then of course in question 6.2 they are asking the days I was absent from UK. So I have to put all the days or the days I was away after I got visa T1.
Evidence of all work related absences (including paid annual leave ) is required from those who are applying under T1.

If I am on annual paid holidays do I have to provide the evidence for that coz it says work related absences

Then 6.3 they are asking
What evidence has been provided to support the reason for all the absence from the UK

Please let me know what you think

So did you enter the UK in 2006 and switched into Tier 1 in 2012 from within the UK ? If yes, then it is the 2012 date.
6.2 they are asking the days I was absent from UK. So I have to put all the days or the days I was away after I got visa T1.
Days you were away after you got your Tier 1 visa.

Yes, you have to provide a letter from your employer for paid / unpaid annual holidays.
Then 6.3 they are asking
What evidence has been provided to support the reason for all the absence from the UK
Yes, letter from employer if employed. If you were unemployed then just mention this in a cover letter along with the purpose of your time spent outside the UK.

Thanks for your reply and your suggestion
I got Tier1 visa in 2011 May so that means I will put same date as this application is based on that visa.sorry I put 2012

Secondly you mention that I have to provide the letter from employer about my annual holidays that's fine for the current employer but my previous was causal so they don't issue the letter. They gave me letter for employment but said they never knew I am going out of country so thy cannt provide any. What you suggest for this.

Also my leave expire on 18may so my 28 before the expiry is 21/04/2016 is it ok to put application on 21st or leave 1 day gap

Thanks

[OR] The letter from employer doesn't have to state you were out of the country but just the dates you were on annual holiday. If they refuse to provide a letter, submit the written communication that ex-employer sent you refusing to provide a letter and explain this in a cover letter.

[OR] No earlier than 28 days prior to expiry of your visa. I would accommodate atleast 2 to 3 days, so as to given some room for error by the case worker.

Thanks

Thanks for your reply and useful comments.

couple of more things want to clarify.

1. My wife came as dependent in 2014 with 1 child when I am applying for there extension do I have to show maintenance for them in there account or my statement is good.
2. I submitted my marriage certificate etc when they got first visa what you suggest I have to send again for them as well.
3. I was looking yesterday dependent form and in one question they ask about reference number of ticket when came in UK but i dont have. Can i just put flight number when they came.

1. Maintenance funds can be in your account or your wife's account.
2. You should submit marriage certificate along with documentation to support cohabitation in the UK. See pg 8 for suggested documentation in the policy guidance (click)

3. Don't remember them asking this information before. But yes, if you don't have it I think it's best to mention name of the airline and flight details if you have them.
