Hi all,

Need an urgent help please.
We have recently applied for ILR tier-1 general set-O.
Today I received a letter asking to provide proof of section 6.3 which is to provide the evidence to support the reasons for all absences from the UK.

The options for the evidence are:
1. Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK?
2. Letter from applicant detailing reasons for absence due to compelling or compassionate reasons
3. Original official documents: (medical/birth/death certificate(s))
4. Letter from travel companies to evidence disruption to travel

Will that be enough If I provide a letter detailing reasons for absence and original contract from my employer which says that I am entitled to 25 days paid holidays?

Has any one experience the same and what was the outcome?
Any help much appreciated.

Thanks.

Hi,

Was wondering if you can help please, what evidence did you provide under section 6.3 to support the reasons for all absences from the UK?

NORTS ... need your help please its really urgent, I have the same query, what did you do with yours? did you get the letters all from your employers stating the leaves? your help is much appreciated pleaseee wrote:Urgent Help Required,
I would be Grateful for advice please, I received an email from My Case worker asking for letter from my employers to confirm that my absences from UK (total of 91 days, scattered over 5 years) are covered by Paid annual leave, Here is the the email:
"I am the case worker dealing with your application for settlement in UK. Unfortunately you have omitted to include a letter from your employer confirming that your absences from the UK during the 5 yr qualifying period were covered by paid annual leave. The Immigration Rules are prescriptive in this regard and I have to have it before I can approve your application. I am happy to accept it by email from your employer so please feel free to forward this email to them"
I am very confused as my understanding you only need evidence if your collective leave is >180 days, My application is SET (o) after 5 years of Tier 1 General Migrant, again does it matter in my case as "Tier 1" and not work Permit holder to prove that my leaves are under paid annual leaves??
Help and advice is appreciated Guys!

What documents can I provide for my previous employer? Would contract stating I am entitled to take paid holidays and salary slip during the month I took holiday are enough?

My Set M timeline

Applied through Settlement checking Service
Application submitted March 13th, 2014
Biometrics letter received March 27th, 2014
Biometrics submitted March 27th, 2014 through Post office

Not heard anything since.

I am working part time and was looking for full time work.
I passed psychometric test for one big firm and was invited for assessment day. I told them my visa status and my application is on hold since.
And tomorrow I have got an assessment day for another big company and I told them my visa status too but they say its okay you just come and we can discuss it in detail.

What should I tell them, how long its gonna be? I really want to secure that job but not sure how to tell them that my application was fairly straightforward and things are going to be okay.
Confused!!

Any advice really appreciated!

I believe once you have applied and are awaiting a response your existing (FLR) status still applies. The issue is proving you are allowed to work as you no longer are in possession of your passport.

Student Visa and ILR and Spouse

Post by imranahmed3651 » Sat May 03, 2014 12:41 am

Hi All,
I have been reading and find helpful this forum.

My story is bit complicate please help me if you know about similar case as mine.

1) I am living UK from 0ct 2004 and have been on student visa and PSW. Currently I am on student visa and visa will expire in June 2014. Can I apply for ILR ? As I got 3 months and 11 days short to complete my ten years .
IF YES then which form to apply.
IF NOT then what you advise me to apply for .

2) My wife joined me Sep 2011 and she joined me as a PSW dependent and later in March 2012 she got student dependent Visa with me and will also expire same as me June 2014. Can my wife apply with me on ILR as she has been living in UK almost 2years & 10 months AND she got extension before 9 JUly 2012 so I think she fulfill the 2 year requirement

IF YES She qualify for ILR then please advise me which form to submit.

IF NOT then please advise me which form I can submit together with my ILR application.

3) My daughter born in March 2014 , which form i need to apply or shall i wait till i get ILR then get her British passport.

Please advise me and I am request all people who knows about similar situation.

Many Thanks

Imran

Finally :)

BRP arrived this morning, documents and passport arrived later in the day.

Can't understand why they took so long (especially when my wife's initial entry clearance took three weeks when they were averaging 2-3 months), we had to cancel plans for a holiday but at least it's here now. I think they have finally caught up on the backlog and delays due to the rush for pre Oct 28 applications. Timeline below. Hope it helps.

ILR Set (M) posted Special Delivery: 12/12/13
Application received by Home Office: 13/12/13
Payment taken: 17/12/13
Acknowledgement letter received: 19/12/13 (dated 17/12/13)
Biometrics letter received: 21/12/13
Biometrics enrolled at PO: 23/12/13
Received BRP and documents 9/5/14 (dated 7/5/14)

Good luck to those waiting.

Hooray, my wife's ILR confirmation letter arrived today (18.5 weeks from application) and signed-for package also arrived the same day.

We are very glad we used the SCS - they did a lot of checking and copying but most of all my wife was able to retain her US passport to use for a holiday last month. Without that this whole process would have been extremely stressful. We had no idea the process would take this long until we found this board.

Our timeline:

Met - Autumn 2009
Partner moved from USA to UK as a Student - Aug 2010
Married in UK - Autumn 2011
Temporary leave to remain (2 yrs) - Jan 2012
ILR (SET(M) application made through SCS - 31 Dec 2013
Acknowledgement letter and Biometrics taken - January 2014
Then nothing until -
ILR confirmation / BRP delivered - 10 May 2014

Thanks - the info on this board has been good,

Ian
