Update and Question

My spouse received her Biometrics request nearly a week ago and I have yet to receive mine. Thought I would give it a week before contacting UKBA. Is this a good idea? I am concerned it may be lost in the post, they didn't sent it out for some reason etc? Anyone else not receive all the requests simultaneously?

Date Received: 21/01/2016
Payment: Debit Card
Payment Taken : 22/01/2016 T+2 from postage
Confirmation Letter dated : ?
Dependent Biometrics requested: 30/01/16
Applicant Biometrics requested: ?
Biometrics submitted: ?
Approval Date : ?
Date Document Returned: ?
BRP received - ?

Hi
I applied for ILR (under HSMP JR policy document 5 years continuous residence) along with wife dependent on 15.09.2015 by post.
Received Biometrics invite on 01.10.2015 from Liverpool office
Submitted Biometrics on 05.10.2015
No enquiries & emails from HO
On 28.01.2016 Received Refusal letter under ECHR Article 8, which is not relevant reason of refusal for HSMP applicants.
Although, I have been given the right to appeal in the First Tier Tribunal. My question to the forum members is:
Is there anyone who has come across such a situation before?
What's the best course of action? Appeal in the Tribunal or Administrative review.
I can see it clearly that the caseworker has not considered & studied my case at all and there's nothing mentioned about my employment, and self employment financial activity, availability of funds, absence from UK during last 5 years.
I also, wish to register a complaint against the HO Caseworker who has been found guilty of severe professional negligence and causing me stress.
Your valuable input may help me to find a better direction.
Looking forward to hearing from you people.
Thanks

Thank you and good luck everyone in the forum. I finally got my ILR. Posted mid October and and BRP received last week.

For those of you who are worried(been told) that HO can access your data at HMRC without your conscent (using your declaration of no 13,....), it is not true.

If they HO have any doubt on your tax they have to enquire you to get them the data from HMRC.

Good luck.

Hi "BDPK" As I have mentioned earlier I have applied my ILR on 08th October,2015 and got a query from Case Worker on 29 Jan,2016 and he motioned his name and address on that letter . Do you have any idea that what is the procedure after replying query back to Case Worker? How long does it take to decide after that? I know its weird to ask but as you can understand I am bit worried at the moment.
Thanks!
