ILR Qualifying period calculation.

Post by skraj » Wed May 27, 2015 11:38 am

Hello guys,

It's confusing while calculating ILR qualifying period under Tier 2.

The 5 years period start from either BRP issue date or COS start date?

My time line below,

1. PSW exiry date: 12th Feb 2011

2. Switching from PSW to Tier2 General for 3 years:
Tier2 COS letter stated 13th Feb 2011 as start date and 13th Feb 2014 as end date.
Applied through post one week before PSW expiry and received BRP with issue date as 9th April 2011 and end date as 27th Feb 2014.

3. Tier 2 Extension valid until 2016 August

Based on the above time lines, my ILR qualifying period starts either from 13th Feb 2011 or 9th April 2011?

Any help please?

I too have recently applied for ILR (postal application). I was advised by members of this very knowledgable dicussion group that qualifying period starts from the date of issue on BRP (for in country). My Cos was assigned on 1/3/2010 and received the BRP dated 27th May 2010. My qualifying period started there from.

Hope it helps and that i am right :D
