ILR Query

I was granted WorkPermit visa on 1st November 2007. In 2008 I applied for HSMP which was refused due to lack of fund in my bank account. However, HO mentioned as I had work permit for 5 years already so I was allowed to stay and work in this country. I did not lose my job or anything. I just wanted to apply as I had the points needed(didn't realise i was 20 cuid short in one month).

I am applying in person for ILR on 22nd October. Is that going to cause any problem?

I am a work permit holder working for the same company.
Do I need to produce an xls document showing my absence and get that signed by my employer?

You need to list your absences in the SET(O) form as explained in the form/guidance. Justification by the employer will only be required if you have business/work related absences which result in you exceeding the allowed theshold of 180 days with any single absence of more than 90 days.

Could someone help me with this part of the form?
My salary is: £30,391.00
How shall I calculate the following two questions?

Current rate of Pay (as stated in the Codes of Practice
– hourly rate or annual salary)

Number of hours this salary is based on


Number of weekly hours = 36
I also get 25 days paid holidays a year.

I chose 3131 as my soc code.

you have to write down the annual salary as it appears for the SOC code in the UKBA list which is

hourly rate x 37.5hrs x 52 weeks

the number of hours salary based on is 52x37.5hrs ( 1950)

Thanks for your help.

– hourly rate or annual salary) {I thought this was going to be the salary in SOC chart which is 28000 for this specific role?}

Also, I get 5 weeks holiday. Shall I still put in 52 weeks in the equation?

My appointment is on Monday so please help me!

first you choose your soc code
then check in the soc list the hourly rate and do the calculation.
then you compare it with yours

yes. you still put 52 weeks. because you get paid for those holiday so it comes up to the total.

on the application form. it is the salary in the SOC code list which should be written.

your salary should only be on the part where it says, what is your income before tax. ( can't remember which page though)

Hi Brian,

This is the only section where they ask about the salary. if I have to put in the salary stated in soc code for this particular role, will the hourly rate be calculated according to my own salary?

your actual net salary is only needed in section 5.3

the rest of SOC, hourly and yearly is from the SOC list based on 37.5hrs.

nowhere on the form, do you have to put your actual hours

Thanks. My SOC code is 3131 and role is system administrator.
For this particular role, the soc salary is 28000.
So, the hourly rate is (28000/52)/37.5 = 14.35


Current rate of Pay (as stated in the Codes of Practice Per annum
– hourly rate or annual salary) = 28000

Number of hours this salary is based on = 1950 hours
Weekly Hours = 37.5


Is that all correct? I really appreciate your help and I am sure many other will benefit from this thread as this part of the application form creates some confusions.
