Hi,

I have 2 questions.

I switched to Tier 1 (General) from PSW on 01.03.2010 and further extended it but was given visa until 06.02.2015. As it stands I would be eligible for ILR on 01.03.2015 but I have visa until 06.02.2015. I have read that one can apply for ILR 28 days before the 5th anniversary. Would I be eligible for that?

Another question is for my wife, she entered UK as on Tier 1 dependent visa on 19.07.2013 and has visa until 06.02.2015. Under new rules she wouldn't qualify for ILR. I am assuming she would need to extend it on Tier 1 (General)
as my dependent but I would be applying for ILR, how do I extend her visa at the same time as I apply ILR?

Can someone please advise?

yes you can apply 28 days before to 1/03/2015

yes your wife need to spend 5 years before apply to ILR (provided if main applicant used to get his ILR through PBS route using Set(O) from)
she can extend her leave along with your ILR application as PBS dependent by using this form
