ILR shortage of 11 days from EC

Hi there,

I had been following this site, ILR is due soon. Here is my case:

Tier 1 General EC approved : 29th March 2010 valid till 29th March 2013
First entry in the UK : 23rd April 2010
Applied for Extension : 18th March 2013
Extension Granted until : 18th March 2015

Could you please let me know when I'll be eligible for ILR,

You are not 11 days short
You can apply ILR 28 days before to 29 March 2015
1st March to 18th March you can apply ILR in any day

Many told me the same that I am not 11 days short; however my duration of Tier Visa
Entry clearence on 29th March 2010
Visa expiring on 18th March 2015

My duration of visa not exactly 5 years rather acounting 11 days short.
The SET(O) form ask: did you spent 5 yeras in UK,
Could you please clarfy my doubt.

Hi Malik44,

I was viewing the thread, however they states the counting of 5 years begins

1. if EC is ussed in uk starts at the date of EC issued
2. if EC is issed outside UK statrs at the day of arriving.

I can not find any clear indication of "arrived within 90 days of entry clearence the case workier
will take the day of EC as the start of 5 yr cont resdency period."

The entry clearance stamp date is counted as the date of the start of the 5 year lawful residence not the Entry date in the UK itself, under the condition that the Tier 1 G migrant enter within 90 days of the EC.

Please do not send us your application more than 28 days before you become eligible to apply. If you do, we may refuse your application with no refund of the application fee (if a fee is charged for your application type). However, you must make your application before your current permission to stay in the UK expires.

Hello,

I am so glad to have your expert remarks.
As I stated my EC was approved on 29th March 2010, arrived UK 23 April 2010, Extension granted 18th March 2013 and expiring on 18th March 2014.

I am no realyy worried as per below SET(O) guidance note:

5. When to apply
You and any dependants applying with you should apply before the end of your/their permitted stay in the UK.
There is a qualifying period to complete in most of the categories on this form. It runs either from
• the date on which you entered the UK with a visa in the relevant category; or, if you did not enter the UK with such a visa, from
• the date on which you were first granted permission to remain in the UK in the relevant category.
If you entered the UK with a visa several weeks or more after the date from which it was valid for use, you may need to apply for an extension of stay to complete the relevant qualifying period.
Please do not apply more than 28 days before completing the qualifying period. If you apply earlier than that, your application may be refused. If that happens, we will not refund the fee and you will have to pay again when reapplying

Most experienced are saying it is okay for me to apply for ILR from 1st march 2015 onwards, but I hear some unsuccessful stories as well.

Could you please help my to clarify or is there any email address for UKBA or relevant authority who can clarify, please let me have those contacts.

Hello IHB,

Your case is simple, why are you complicating it! ?.

You entered UK within 90 days of entry clearance. Good. Continuous period not broken and no shortfall yet

Applied for extension within 28 days of initial tier-1 visa expiry. Continuous period not broken and no shortfall yet.

So for ILR, apply for it 28 days before your expiry of your tier-1 extension. Simple.

YOU ARE NOT HAVING ANY SHORTFALL based on the information you have provided.
