assuming your absences were work related (or for compassionate reasons), and you currently have T2 ICT leave, your 8 month absence May 09 - Jan 10 has to be broken up into two chunks neither of which is longer than 180 days.
The earliest you can achieve this will be around mid-July 2014 and you can apply 28 days before then.

Dear Gurus,

i am planning to apply my ILR on 21st July . I am giving you my absences below.
Period Total Absences ( days )
Year 1 21JUL2014 - 21JUL 2013 0
Year 2 21JUL2013 - 21JUL2012 104
Year 3 21JUL2012 - 21JUL2011 5
Year 4 21JUL 2011 - 21JUL2010 30
Year 5 21JUL2010 - 21JUL2009 169
Year 6 21JUL2010 - 21JUL2009 72

After calculating the dates if i apply around july end the gap is 169. When i calculate backwards the period between july 2009- jan6 2010( which falls under my first year) i am out of UK will be it fine ?

Can you please suggest.
