remaining PBS dependent LEave if Migrant gets ILR

HI everbody Please if you can answer my Question.
ME+2 CHILDREN eligible for ILR on 14 Sept 2016, husband still in Probationary perod till Aug-2017, but holds
Valid PBS Partner Leave till 14 Sep 2017.

Q.1. Will his current leave b valid or he needs to change as he will complete his QP of 5 years on 14-08-2017
Q.2 Is his presence essential for me & children at the time of application.

Me and my chidren got our Tier 2 Visas on 14-09-2011 (before 09 Jul 2012 rules)

What is the basis of your ILR application? Is it five years of PBS or 10 years Long Residency?

Are the children born in the UK or abroad?

Basis of my ILR is Tier 2 General,issued to me and my two children on 14th September 2011.
Children were born in Pakistan.

Assuming you are applying on the basis of 5 years on Tier 2 General ;

Q1 Yes his visa will still be valid. No need for him to change visa.

Q2 Not sure, HO might ask etc.
