Hi,
Tier 1 initial application 2011. Application claim was 37k
Self employed 22k, employment 15k. Hmrc submission was incorrect and was total 17k which I amend on early 2013 to 37k and paid the tax, also HMRC send me letter in 2013 mentioning new figures for 2011.

I'm applying for ilr in June 2016 first week. My extension and current income full employment income and no more self employment income after 2011.

After reading issues with tax in this blog, today I contact HMRC just to cross check my 2011 record and they says my income was 17K :( which I amend and paid tax too for 37 already 3 yeas back. She agreed I paid tax on 37k but my sa302 not updated. I request to update but seems it will take too long, she says someone will contact me over phone in 5-7 days to discuss.

Now seems HO check everyone HMRC. I have one month to apply, can anyone advise me on this which could save me!

I'm afraid because day before yesterday someone refused on same day service who amend 2011 submission in 2013, paid proper tax also submit the HMRC letter. But case worker still got old figures and said we have to make decision based on what we got from HMRC. Seems HMRC collect the additional tax but did not update the SA302!

Anyone face this issue that tax paid long back but HMRC did not update the records. Kindly share if you have any advice on this...

Its a mystery why people with complications in their cases still insist on attempting to apply via same day service. Its clearly not appropriate to follow this route.

very true, this days everyone going for same day service. I will use the postal service, just with a hope that they will consider the HMRC letters (where they mention 2011 income tax recalculated based on 37K) and might recheck/verify with HMRC though may be the chances are less.

I am surprised that case worker did not even consider to recheck with HMRC that provided HMRC letter claiming was genuine or not and refused even though HMRC letter shows correct tax.

If anyone have idea, except SA302 what kind of document I can add to prove that on 2011 income was 37k ( I have HMRC letter showing tax calculated on 2011 with 37k), also how can I accelerate HMRC to update my record which also I paid tax 3 years back.

Any advise please...

Do you advise that I should mention that SA302 update (I update them in 2013 and they send me new figure but there side SA302 not updated which I noticed yesterday) I urgently require for my HO application, also saying my 4 weeks date line!!!

What does the "tax year overview" show for the year in question? Old figures or new? Log in to your HMRC online account and check.

yes on my HMRC online account for 2010-11, its shows the tax amount (8k) which is for 37K income. and its showing correct here since I update in 2013 but from here probably it do not show the income amount.

also I can see how much tax on that year I paid but did not show what was the income amount. I am afraid only that is HO will ignore my tax paid documents and also letter that HMRC sent to me with 37K amendment calculation!!! (do not know why they did not update on there SA302)

Taking a letter from my accountant, mentioning that there was an error and amendment was done in 2013 and tax paid accordingly (also I have a copy which sent to HMRC in 2013 for amendment ). is the accountant letter will be helpful and give more strength on this case to consider for HO

HMRC did not amend, they only re-assessed your claims.

That is the problem.
HO only have access to the old one.
HMRC doesn't update SA302.
Too sad.

Ok so only way to Update the SA302 via HMRC. which very lees likely within the time I have :cry: bad luck.

still I will sent the copies for the re-assessment with my ilr application, but realize the chances very less :cry:

Include the letter "HMRC send me letter in 2013 mentioning new figures for 2011" plus covering letter from accountant confirming all taxes are up to date.

Include all other SA's which should be correct .

Hopefully you will sail through.....

suggest you that to submit your ILR applciaiton along with proper cover letter from UKVI approved accountant. then you have high chance to get applciaiton approved.

1. If ilr refused, will I be able to apply for leave to remain on t-2 ?? ( my current company will help me if its help me).
2. Will I be able to apply on t-2 during AR or after AR refused?
3. If I can apply on scenario 1 or 2 then within how many days need to apply?
4. If scenario 1 or 2 is possible then is that break long recedency route ( I'm now 8y)
5. If scenario 1 or 2 possible than what will be status during application pending ?

6. Or none of this possible and only way to fight will current application!!

So many thing going on mind that why ask this. Thanks in advance....

Just to update the final outcome on this topic.
Applied via Sheffield PEO T1g to ilr
(Earlier my Decision was for postal application but for some others factor pressure Went PEO)
Application APPROVED in PEO
Date: 1-6-16

T1g
Initial app: employment + self emp
Ext app: employment
Ilr app: employment

2011 tax return self emp amount amended in 2013 ( sa302 remain old and I had revised calculation). However no question asked and was very very quick approval which I never imagine that it could be that much fast.

Earning doc provided
1. Last 12 month payslip
2. Last 12 m bank state
3. 2011 hmrc revised calculation
4. 2011 tax y overview from hmrc online
5. 2011 submission copy ( corrected one )
6. Acc letter saying we were his acc for 2011 and confirm in this y his income was 36+ and tax was xxx which fully paid.

May concen was, how they see my ammenment which I done in 2013( for 2011) and was very big amount. However on May case I was lucky enough. I have mentioned this correction in cov letter and in self emp questions provided form too.
