Tier 1 general visa to ILR Queries

hi all,
i got my initial tier 1 general visa on 09-02-2011 and then i got extension till 14-03-16 now my five years are completing on 08-02-16. but someone told me that i can apply 28 days before but i am not sure whether i can apply 28 days before the expiry of my current visa or 28 days before completing the exact 5 year period.

If your visa was granted on the 9/2/2011, was this an in country application or did you apply from your home country? If from home country, on what date did you enter the UK?

I applied while I was in the UK on Post Study Work visa. I applied by post in Dec 2010 and got visa on 09-02-2011

You can apply anytime within 28 days before 9 Feb 2016.

Hi there,
I need your help to understand the questions in ILR SAT (O) form

1: Section 12L point 2 which says
" For the period before you were granted leave as a Tier 1 General migrant , Documents showing that you met the relevant requirements of the immigration rules".

currently i am on Tier 1 General and going to apply for ILR. Before that i had PSW for one year and before that i was on student visa. Could you please tell me what documents i should send with my application.

2 : Section 6 Question 6.2
"Have you had any absences from the UK"

in last 5 years I have travelled outside the Uk once a year and usually stayed 3 weeks and once i stayed 6 weeks just for family holidays do I have to mention this and provide all the date for this travels.

I thank you in advance for your assistance

Unfortunately I don't know answer to Question 1, probably more experienced members would be able to answer.

For Question 2 - Yes you will need to disclose these travels with Date you left and date you arrived back in UK along with the reason for travel. In your case you can say annual vacation or family visit.
If you are in an employment, you will need a letter from your employer to certify that you were under employment when you travelled outside UK.

Question 1
PSW and Student visa are not counted and irrelevant to ILR applications on Set(O). They would only be relevant if you were applying for ILR based on 10 years long residence. Read the PBS guidance on what you need to submit.

the thing is u can not apply ILR on SAT (O) for long residence route and even in this section it specifically mentioned Tier 1 General Route

The form for long residence ILR is Set(LR).

I asked my employer about the letter discussed, they said firstly we do not have the records for the last five years to show on what dates you had taken your holidays and as an employer we do not know whether you had left the country or not
what u suggest now

I would be very concerned if your employer has not maintained your employment/salary/holiday records. This is a requirement that they have to do.

They need to confirm your absence as annual holidays. They do not have to mention where you went.

if no minimum funds required than how to complete the 100 points required
we suppose to claim points for
Education
age
earnings
uk Experience
and then 10 points for language and 10 points for maintenance
am i right guys

There is no requirement stipulated for maintenance funds. Depending on when the initial grant of leave was you will need to be able to earn 75 or 80 points

There is an English language criterion under KOLL requirements but there are no points associated with it

hi all,
just wanted to ask that when I got my extension under tier 1 general I had to earned minimum £35000 per annum to claim the relevant points now I am going to apply for ILR so do i have to show that I have earned minimum £35000 each and every single year during the continuous five years period on Tire 1 general.

You have to prove your income in any 12 month period from last 15 months.

Yesterday i had appointment for my ILR application which was approved and i got my ILR therefore, I would like to thank everyone on this forum specially CR001,RRSB2012 and PT100 for their valuable support and advices.

urgent advice required please
I was on Tier 1 general visa and recently got my ILR but unfortunately my wife could not pass the Life in the UK Test. Now her visa is about to expire could anyone please suggest what form she should use to extend her stay and how long she will get the visa and does she has to go to the 10 years or 5 years route and complete the 10 or 5 years from now or she can get any other visa and as soon as she passes the Life in the uk test can apply for ILR. she came to the uk in June 2012 on a PBS dependant visa and we got two kids who born in the UK.

i went to croydon in person and after submitting my application with in about 90 min they called me and said your application is approved and returned all my documents.They never asked me any question except while submitting my application on counter they asked if i have any conviction. I sent the following documents:
Pay slips
P60s
Employer letters
Bank statements
Earning summery form HMRC
Self-employment earnings in 2011
Tax returns
kids birth certificates
flat mortgage Papers

Sorry if this is a stupid suggestion. Is it possible for your wife to re-write Life in UK test. If she can pass the test, that would be the easiest way out.
