Post by ruby321 » Mon Jul 20, 2015 7:27 pm

Tier 2 (General) Granted on 01/06/2010
Entry UK 20/06/2010
Expired 01/06/2013

Renewal Tier 2 (General) Period 25/06/2013 - 16/06/2016

It is any trouble for me if i break the 28 days rules which my Tier 2 (General) expired on 16/06/2016. Please advice.

You cannot find it in Appendix J because Accounts Assistant SOC code 4122 is below NQF level 3.

I am looking at "Tier 2 occupational codes of practice - version 03/10: valid from 01/03/2010" and SOC code 4122 is listed under "Lower Skilled Jobs" (same as the current Appendix J) and it goes on to state:
3. Lower-skilled jobs
The following occupations do not contain any jobs at NVQ or SVQ level 3 or above. There are no codes of practice for these occupations. Sponsors cannot issue certificates of sponsorship for any jobs in these occupations:
So how did you manage get on TIer 2 (General) in 2010 based on this SOC code?

Or am I missing something .... ?

I found the on guidance note:
Please do not apply more than 28 days before completing the qualifying period. If you apply earlier
than that, your application may be refused. If that happens, we will not refund the fee and you will
have to pay again when reapplying.

If i apply ILR now, mean i over the 28 days rules as above? am i?

Thanks,

You may apply any day you wish, provided you meet all the other eligibility requirements.

Refer to the Latest version 04/15, SOC code have been revised with rates as below:-
Salary rates: New entrant: £21,500 / Experienced: £28,800
[Source: Annual Survey of Hours and Earnings 2014]

But I only earned annual salary £25,000 (with 5 years experienced), will it effect my application? Please advice?

One more question that, refer SET (O) form - Section 3 - Which Category (under Section B) - Page 13?

Which category should i tick on because my BRP stated Tier 2 (General)? Confuse?
- Work permit holder or
- Tier 2 Migrant

Please advice?

Thanks for help,
Ruby

One of the requirements for settlement as a TIer 2 (General) migrant is:
245HF(d)(ii)(2) wrote:) in the case of a Tier 2 (General) Migrant applying for settlement, the applicant is paid at or above the appropriate rate for the job as stated in the Codes of Practice in Appendix J, or where the applicant is not paid at that rate only due to maternity, paternity or adoption leave, the date that leave started and that the applicant was paid at the appropriate rate immediately before the leave.

Just one payslip and a corroborating second evidence (e.g. - bank statement), I believe.
See 245HF-SD for all necessary details and requirements.
