When to apply for Set LR (Long residency)?

Post by talkhome » Wed Mar 09, 2016 4:34 pm

Hi can someone please advise if I am correct:

Applicant Entered UK on: 06th August 2006
10 years will complete on: 05th August 2016

Long residency application on premium service can be made 28 day before completing the qualifying period.

So if I am right application can be made using one day Premium service on: 09 July 2016 (Saturday) ?

If that date is within 28 days before your 10 years residence, then yes. It can be any date within the 28 days, it does not have to be the first date of the 28 days.

Dear Guru,

09th July 2016 is the 28th day.

what I got confuse is if somebody enter on 06th August 2006 will his 10 years complete on 06th August 2016 or 05th August 2016.

As if it is on 05th August then 09th July 2016 is a safe date as it is the 28th day otherwise it will become the 29th day.

10 years complete on 06th August 2016
This one as far as I am aware. For the sake of 1 day, do you want to risk £1875 application fee plus the £500 premium centre fee by applying 1 day too early?

I got your point. Let's stick to applying on 11th July on the safe side.

Thank you Guru.

Set LR Tax issue (Need help)

Post by talkhome » Sun May 01, 2016 11:34 pm

I have been working in the UK since 2007. I recenlty requeted SA302 (My tax record from HMRC), everything turned out ok except year 2011- 2012.

In 2011-2012 , i earned £1900. I have company wages slips and P60 but HMRC does not have any record for that year.

I have never submitted any P60 during my past extensions.

Should I just keep quiet and go for Set LR or should I need to contact HMRC and request them for amendment/update of this error/mistake?

If you used that income to get earning points in your initial application then it would be wise to send request to HMRC to update the record before going to ILR.

Contact HMRC as a matter of urgency and apply by post, not in person at the PSC. You may want to read through this thread:

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

@talkhome,

If you're self employed in the same period and haven't declared / missed to declare that income (P60) in the selfassessment, then P60 figures may not show up in SA302 as it's happened in my case. did you request for employment history from HMRC? you should have PAYE information in the employment history.

If the figures are in employment history but not in SA302, then you many need to speak to HMRC and find out if you need to pay any additional tax as result of income from multiple sources and get it updated in HMRC records so it appears in SA302. Correct me if I am wrong.

Dear Guru,

Just a quick question:

Now I have checked the wages slips for the year 2007/2008, I sadly discovered that I have worked more than 20 hours for 6 weeks. I work 3-4 hours extra at £6.4 Per Hour.

Do you think it would be a problem? Apart from this my all 10 years record is clean in terms of working pattern..

I heard that employers in 2007/2008 used to send form P35 and P14 on annual basis so HMRC will not have record how many hours i have worked and at what rate i have worked. Is this correct?
