Wife&Hubby on different Tier1 visas(wife eligible 4 ILR)

Post by ILR666 » Wed Jun 09, 2010 4:06 pm

Hi
I don't know whether there is similar query somewhere, but I couldn't find anything on similar grounds.
Please go through my situation and suggest me how to proceed

I came to UK on work permit in Aug 2006
Changed to Tier 1 from April 2009
So, I'm eligible to apply for ILR from Aug 2011 (though I can hold until April 2012)

My husband holds his own Tier 1 visa, currently looking for job
His visa expires in Nov 2011. He was NEVER on my dependent visa

In ideal way:
He need to extend his Tier 1 visa in Nov 2011
I need to apply for ILR in April 2012
After I move to ILR, Again I need to apply for his dependent visa
All together, three applications totally costs 3000£

Is there any sort of following option: when I apply for ILR (between aug-nov 2011) can I apply him as ILR-dependent.
I have no clue whether there is something like this.

I know that to apply for ILR, he should be on my dependent visa for atleast 2 years
But is there anything called ILR-dependent? or something similar

Thanks in advance

under CURRENT RULES I think it's possible to get your ILR then add your partner as your dependant... Having said that, your ILR is after July 2011 - so you fall in to probabtionary citizenship rules, not sure how it affect you....
