my wife got her approval today, and she wasnt asked anything like traffic fine during the process, although she had a fine this year for using mobile phone while driving. she paid and that was it.
she applied in march.
that weird that they must "sometimes" ask to prove that you have paid the fines, or refuse probably depending on the degree of the fine.

For anyone out there needing help and clarification with regards to citizenship, this is the best forum to get it. U may get better advice than any lawyer out there can give. People should also try as much as they can to give genuine and sincere advice to anyone that ask. It has helped me to prepare for this and without it,my application may not have been successful on time. Thanks every1

I got a stampEUFAM in October 2009 on the basis of my brother; a British national exercising his EU treating right living and working in Ireland for 7 years. I was living with him and his family in County Kildare for about 7months before I got a job and then decided to move closer to work in Dublin. I have been living in my present address since 2010 and self-sufficient of my brother since then. I have been in full time employment since the 10th of March 2010 till present. We lost our father in in July 2011 and my brother and I left for Nigeria to visit the family back home and prepare for the burial. After the burial I flew back to Ireland and my brother decided that he wants to handle my dad’s business at home and he shuttles between Lagos and Ireland to spend time with his wife and kids in Ireland. I was aware his wife and children relocated to the UK last August but nothing was communicated to me by my brother about him not living in Ireland as I don’t see him that often. After 5years in Ireland I recently applied for citizenship on the 17th of June 2014 which I received the 1st Acknowledgement letter and also a letter asking for additional document which I have sent to DOJ and received acknowledgement letter for my correspondence. In January my wife who is a non EEA National with indefinite leave to remain in UK travelled to Ireland for the purpose of getting married to me at the Dublin Registry, everything went okay and we went to the DOJ office in burgh quay but my wife wasn’t registered, we wrote to DOJ and my wife who was on a stamp C visa to Ireland was asked to leave the country after 5 months to go back to either UK or Nigeria to apply for a spousal visa which she did and was granted the spousal visa in the UK. At the point of entry just last week my wife was told that they have discovered that my brother as left the country since 2011 and that means my stay in Ireland has been illegal but she was allowed into the country and was asked to go to the DOJ’s office and see if she can be registered. We got there and we were told that my wife cannot be registered because of my situation and that she should wait for the decision from DOJ. She was pregnant before she was asked to leave the country and now 7months pregnant. She decided she can’t wait for another 5 months before she will hear back from DOJ and decided to go back to the UK so as to be able to have free medical attention for the pregnancy as she will not be qualified for that in Ireland because of the situation. I wrote to DOJ to inform them about the situation and what actually happened but I’m yet to hear back from DOJ. My question is, will this circumstance affect my citizenship application?

U said u've had ur stay since 2009 right? But now the immigration guys have now told u that bcos ur brother left the country in 2011 that mean u've been illegal
Since 2011. Doj want 4 yrs residence out of the last 9 yrs. and
And one year year continuous residence making it total of 5 yrs. if u've been deemed illegal Alien since 2011,that would have given u 2 yrs residence and no continuous 1 year. Is ur brother still filing his tax return? If no! He should've been for ur sake. And u probably should've kept in touch with him knowing that he could jeopardise ur stay. Since he's shuttling between Lagos and Dublin,he could still be residence in ireland, unless he declared not. All he has to do is show proof of address and tax clearance certificate and they'll remove that clause on ur immigration status.

Hi Janet, thanks for getting back to me regarding my question. I have asked my brother and he said he hasn’t been filling any tax return and whenever he is around in Dublin he does not work but to spend some time with his wife and children which could be between 2 to 3 months per visit, he confirmed he did not declare he has left the country for somewhere else because he still shuttles between Lagos and Dublin. I know it’s all complicated but is there anything I can do for DOJ to assess this based on me working full time with a permanent employment, paying my taxes for the 5 years and being of a good character without any conviction nor fine? I will soon be a father in a couple of months and the situation I am in at the moment is not making me happy despite looking forward to fatherhood.

So sorry to hear that,it's gonna be fine. U'll need to follow these steps... Has ur brother ever file a tax return b4? If he has, then easy to go from there, all he has to do is to file tax return for 2011,2012 and 2013. If he hasn't file any previously which I doubt cos how else was he able to prove he was exercising his treaty right? Unless he's into employment. But,if he has never file, all u'll need for him is an address (u can use ur home) and his details, then he'll request to register for self assessment for the purpose of income tax et cetra. U must do this in order to make like easier for yourself as inis guys go by the book, empathy is of least importance.

Hi Janet, my brother was in full time employment untill he decided to be shuttling between Lagos and Dublin and now that his wife and children are no more in Ireland since last year August he has technically left Ireland, how will I be able to file in tax return for 2011, 2012 and 2013 in his absence and also register him for self assessment for the purpose of Income tax? If there is any advice you would like to give me or if should get a lawyer for this case please you can send me a private message as I’m deviating from the topic of this platform which is citizenship Approvals. My stamp 4 EUFAM expires in October this year and I was hoping to visit my wife in the UK in August, I just want to know if there will be any issue when I coming back into the country concerning the matter at hand.

By case law you can be resident in two places. There is no magic in your situation, listen to janet advice. They inis work by the book, under eu law an eu citizen can be absent in the host country for 6months and aftet 2 year he is no more a resident unless he/she can prove he still has a ties with the host country like address, bills, doctors, business etc which you can show through book. When you were granted resident the letter that comes with it stated if the eu national leaves the country permanently then you are deemed not to be a resident too. Your case is complicated, there is no magic here, going to solicitor is useless because most of them dont know much about eu law. This forum will give you better advice than solicitors. Anyway if an eu resident card is withdrawn it automatically trigger an in country right of appeal but dont pray it get to that level your only saviour now is your brother to make things right because your stay in the country is through his rights not how many hours you work or how much tax you have paid. As for the citizenship things I dont much about that but I know the right of a non eu citizen to live in a country where the eu citizen is living, the rights derived from the eu national himself.
beloved is the belief that there are inherent differences in people's traits and capacities that are entirely due to their race, however defined, and that, as a consequence, justify the different treatment of those people, both socially and legally.
