Why do you think you need a FP?
What is connection to stamp 4?
Do you have EEA/ British sponsor?

So, yes, you can apply for FP if you wish to join/accompany sponsor in UK.
In your circumstances it is not essential but a FP may simplify your entry.

If both the husband and wife are living and working in Ireland, and the non eea husband want to apply for EEA family permit would that be possible? I am talking about a person on stamp4eufam applying for a UK EEA family permit.

Yes, that is what it is for - if they are traveling with (or joining) an EEA national in UK.
They can't go to UK by themselves.

Thankyou for replying,
but the directive says that under the European Communities Free movement of persons and directive 200/38/ec on the rghts of citizens of the union and their family members to move and reside freely in the member states.
UK is still in the EU so the EEA family permit doesnt make any sense. If i were to travel with my spouse than why do i need a permit then? does that apply to all the member states or just the UK?

It does indeed & as I replied in 1st instance (above):

Be careful here.
If someone has a UK visit visa and then applies for a RC they would have to be sure of getting the RC.

This is because a 'visitor' on a UK visitor visa is expected to leave UK at the end of their visit.
If someone applied for a RC and failed it is likely to zero their chances of being granted any future UK visitor visas.

All that is needed to continue on an EU immigration migration route (for example, involving Surinder Singh) is entry into UK.
That is what a FP is designed for: entry into UK.

Alternately the Directive 2004/38/EC can be invoked directly, see:

Thanks noajthan,

Thanks for the detailed response, however i was think a situation where non eea national hold a residency card as well as a Uk visit visa. While travelling between Ireland and Uk (and if not encountered by immigration staff) will still a visit visa be a problem? Even travelling by air there is no stamp of entry on passport to enter Uk.

I know its a a bit messy bit just wanted to find out if it is appropriate to apply EEA while in Uk. Thanks
