A couple of issues:

1. Its referred back to UK high court so they need to rule on it, which has two complications - time and twisting

2. Twisting - now UKBA will try to find a way to twist terms in this judgement and create new rules around it
making it even more complicated to pass the test. e.g. the applicant had a house in both Spain and UK and
they can start requiring you to own houses in both countries (home and away) in order to accept residence cards.
It will be illegal but will need another case and judgement which may take another 4-5 years.

So, it all remains to be seen.

To be honest it's really a great news for the couples who want to visit Britain. I am sure with the fact that Theresa May will not like this idea. She always go very tough on non EU citizens. But thanks to the EU court for making this easy.

I also agree that UK is not going to accept this ruling that easy - They will make it further complicated and another case hearing could take years again....

Does anybody know anything about the related on going case? Its referred to in several news articles but no mention when that will resume. I'd love to keep track of this, see how it unfolds
