But what troubles me, is that you wrote about the outcome of a judgement which has yet to be published or Promulgated.

I don't understand how your solicitors can say the department lost, when a judgement has yet to be published.

I can say from my experience that the Department is likely to lose, put the way you said it, is more certainty, which no one can say until after promulgation.

what is the effect of the judgement on our applications?
If the decision would be for our favour then they will decide our applications as well or this judgement is for sham marrage?

I Think INIS playing Games with us, First they Delayed our application because of Garda Opration then UK EU Referendum and now this unseful judicial test case of high court, they just want to dicourge applicants and I think this High court decision will not issue this august we will pospone till next year untill after UK Switch Article 50 of EU then they will refuse all applications. At least they Can refuse us now we apply in other country or finish this hard stress. This unlimited waiting really did my patience running thin. May god bless them

I see most of application are being refused because of insufficient proof of Marriage and for my spouse I attached Nadra Marriage Registration Document. Solicitor told me I should have attached FRC.

Will this be a problem?

Also in case it get refused, how long appeal taking?

How did you get your marriage certificate nadra registered? I have been told to do that

hi, you need to go to NADRA for issuing computerized marriage certificate, its different than nikah nama. You'll have to download a form or get it from nadra office and attach 4 documents with it
One valid and attested Copy of Groom & Bride’s CNIC
One valid and Attested Copy of both parent’s CNIC
Copy of Urdu Nikah Nama
Attested Copy of Molvi (Nikah Khawan) CNIC
Check their website for the documents you need for making this certificatebut i think its the above as far as i remember. In addition to this also make Family registration certificate(FRC) from Nadra. For FRC u'll need yours and your spouse's cnic only and i think the charges were 1500. They issue that the same day, you won't have to wait

Hope this helps

Hi everyone ,

Join spouse/Non EU , Long stay (D)

I am british citizen, using my eu rights and currently working in Ireland since last year, wanting my husband to join me here in ireland.

Application submitted: 29th February 2016 @ Gerry office Lahore, Pakistan
Application received at dublin office: 01st June 2016

The wait is never ending .......

As i am already working that is why we applied for long stay (D) , is that right? I submitted papers myself , i didnt get help of a solictor , have i done the right thing ?

is long stay (D) Join spouse visa , causing long delays too ?????

It is the short stay C visa that you need.

Ohhh , do you think it will be a problem now cause I have applied long stay ? Instead of short stay ?

I included all the paper work which was needed
Documents submitted :
Wage slips
Tenancy agreement
P60
Invitation letter
Relationship letter
Bill (addressed on property )
Marriage certificate (Nadra attested , English / Urdu )
Marriage wedding card
Marriage photos & other outing photos (after marriage to proof genuine marriage )
Skype communication (after marriage, up Untill we submitted papers)

Have I missed anything ?

Hopfully they shouldn't refuse on the base of wrong category if all correct documents are submitted , they may just issue a short stay visa ?

On inis website under join family page it states " if you would wish to come to Ireland to reside longer than 3 months with a family member who is an Irish citizen or who is lawfully resident in Ireland you can apply for long stay (join family) visa".

I believe I am lawfully residing in Ireland as I have been working since last year , got my pps number to and paying my taxes . So applying for long stay shouldn't be a problem.

Correct me if I am wrong ?

Hi thanks for your reply. I attached nadra marriage registration but not FRC. Will that be an issue?
And
Is it possible to get FRC now and submit to gerrys? Or will they ring to me to het FRC OR I'll have to appeal?

When we submitted documents to gerrys they checked all documents and said i applied for long stay instead of short stay. So they attached additional form for short stay with my application. And said all documents are ok.

Another thing, my application was recieved in Dublin on 13 jan 2016. So, if processing date changes tomorrow i should get decision.

Regards

Hi brother, i did the same however at gerrys they changed my form from long stay to short stay.

If you provided required documents for long stay they you should get visa

Good luck.

Thanks both

Hopefully shouldn't be a problem

Documents are submitted as required on website

One more thing , I submitted my papers an received to Dublin in July and as of yet no response. My tenancy agreement which was a year agreement has expired on the papers I submitted to visa office , although I have got a new tenancy agreement for another year . However visa office would see my tenancy agreement as expired on September 1st and haven't got my new tenancy agreement . What should I do ? Should I wait till they look at my case and if they ask for new tenancy agreement then send it to them ?

Or should I contact them and submit my new tenancy agreement ?

Thanks in advance
