but if you are a british citizen will be harder, you cant just go back to UK with your spouse, you have to go trough the Surinder Singh way...or just start the process in any eu country and when you have article 10 card fly back to Ireland, depending where do you want to accomplish the full SS way.

I don't want to go for Surrender sing Route I just want to settle in a EU country with my family, now I am going to wait for Irish high Court Decision if it become for our favor then I will wait for Irish Visa if not I will try Schnengen zone.

The High Court decision is still awaited. Sinnott Solicitors, the Solicitors for the Applicants in the test cases will post an update as soon as there is any update on the judgments which were supposed to be given in August. As the courts have re-opened since last week we all hope that the judgments will be given shortly. The decision will affect the processing times for all visa applications, so it will not just effect the people who have taken judicial reviews.

How Long the court was closed and why??

Judgment in the test case issued this afternoon, the court held that the visa office must issue a decision within six weeks of the date of their court order - the Minister for Justice might appeal the decision but it will have an important impact on the processing of visa applications for family members of EU citizens who have submitted applications to be granted visas to accompany or join their family members in Ireland - keep an eye on the website of Sinnott Solicitors, the solicitors who have took the case to the High Court for their client, who will post a detailed update on the judgment next week - www.sinnott.ie.

This is interesting , I have checked the courts website and it is yet to be published.


But if this is confirmed it will be a positive development.

I can see the person who posted this is a reliable people and there is reason to believe what he or she has said.

It seems as positive and reasoned as it could be UKBALOVESTORY.

I am still studying it. A very detailed judgement with many information for my brain to process.

My preliminary reading indicates it is a positive decision.

Dear unaobrien1 thanks for the great news! Could you please tell me what is the affection of this decision on our applications, I mean this court was only for one application that the court decided for them. And as there are 7000 backlog is it possible that INIS could be able to decide this much applications in just 6 weeks?

As I read it, there is no any effect or impact on our application, that court decided only for Atif Mahmood application.

It means that minister accepeted the decision and didn't appeal!

But steal I am confused, the decision is just for favor of one application not for all. What is the impact of that decision on other pending applications? Will the court decide for all pending applications in six weeks???

There is no indication from the article that the minister does not propose to appeal.

However it seems to me, based on the reasoning of the decision, that the minister has little or no grounds on which she can mount a credible challenge.
