SS route & Uk immgration history of non-EEA spouse

Hello everyone, my question is mostly people come to ireland when their status in uk is zero , overstayed, curtailed or refused from ukvi, when they successfully get stamp 4 and 5 year residency card and then go back and apply for Uk visa for residency ,
1 -; Does non eeu spouse's previous bad uk immigration history matters when he applies from uk to replace his irish residence card into 5 year uk card??
Please share your experience and some advice.

UK bad imigration history effects your irish visa in only one case.if you have been convicted and been
given a 12 month sentence in a UK Prison after that deported to your country.other then that overstay and illegal working has nothing to do with irish visa at all .remember while applying for ireland you are applying
under EU law not UK law so they cant refuse you because of UK law.only case is if you have serious conviction and a CCJ in UK can affect your case.

Hello, thanks for reply but i think i had to clarify my question a bit more as i wanted to know after getting irish 5 year card if i go back to uk and i was a overstay in uk, when i apply for eu2 there will they bring up my old immigration history and refuse my application??

Is your family member british citizen? if so there will be no chances to refuse the application :)

Yes she is british,and why they will not refuse if my wife is british ? Can i also go back on stamp 4 and apply for eeu2 or shall i wait for 5 year card and then go back to uk. Thanks

Dear Mr tayyab99 we can not assume weather they will grant you entry or not UKBA normally discourage
and demoralize such applications.to control immigration thats there normal practice.other then that you have to make your application strong enough to make them helpless to give you the visa.and top of everything recently UK has introduced center of life test for EEA applications which means in the country in which your spouse in exercising the treaty rights she/he have to proof that they have changed there center of life in that country which makes it more harder to get approved.so staying long in ireland is no harm it will make your application more stronger not weaker.if you rush back to UK then you will stumble :P
