Travelling with EU fam member to UK

Post by Danny65 » Sat Mar 19, 2016 4:04 am

Hello everyone...
I recently received my 5years residency card. I am planning on traveling to UK with my british wife who is exercising her treaty rights in ireland. I have seen few posts here that if you hold residency card you do not need a visa to visit EU countries but not sure so if somebody have had similar experience please advice me on this what is best for us.
Secondly we want to move to england on parmanent bases can we go there and apply for EEA2 straight away or do we have to stay in ireland for 3months as i have come across somebody and they say we have to?
I will appreciate any help. Thanks

Hi Danny65,

The process of entering UK is clearly mentioned on Uk give website, they have advised to apply for family permit before entering Uk in order to avoid any delays/problems on boarder, the family permit usually take 10 days, once you attain family permit and in Uk u can apply for EEa2 straight away,

No problems, You can travel to the UK with the 5 years residence card if it is issued under article 10 of the Directive.

Hi member
We have been living here for just over a year.
Hamza2013
I have history in uk as i were an overstayer. Would that effect the decision if i apply for family permit?

But it also says on that website that you do not require to have family permit to travel to england but yeah it might simplify your entry :?

Yeah you are absolutely right and the UK boarder officers don't really know about the EU FAM holders right and it would be better if we have family permit to avoid problems when entering the UK.

I think family permit takes time and i will be travelling via ferry so i hope i dont come across any immigration officer. Another thing on my letter it says residence card under regulation 7. Does yours say the same? Im sure it suppose to say regulation 10 :? Plus i dont feel comfortable applying for family permit coz any single mistake they will refuse it and i have history there as overstayer so i think best way is to sail across.

Hi Danny65,

I suggest to read through the board in detail, your right to travel with family member verses ur uk history is different, family permit are for British families to travel together on a status of family member.

The last thing u would want is to face questions as how did you get in UK etc.

Gurus / moderators please shed some light on this.

This is nonsense.

There is a complete BF Operations Manual at IOs disposal to tell them what to do.

They don't just make it up as they go along.

Yeah I know people travelled to the UK with the stamp 4 and they were all British spouses, but some people had problems with the immigration officers at the boarder cross and some were fine.

There is ID check in the sail cross but incase you need to bring all the relevant documents to explain your right.

For the family permit you can apply online and you need the following documents:

Your valid passports
2 passport size photograph
Your marriage certificate

For surinder singh case you need to show them that the EEA/ British family member genuinely moved to another EEA country such as Tenancy agreement, bank statements, job offer letters, wages slip, p45, p60, GP registration letter, revenue letters..
