Divorcing a refugee who is the main applicant and the status

Post by Besselsleigh » Fri Mar 07, 2014 11:34 am

Hello,
I have a refugee status in the UK, my husband is the main applicant, me and my daughter are his dependants.
I want to divorce my husband – how will it influence my status now?
And what will I need to do in 4 years to apply for ILR – will I have to file a separate petition for that? Will I be entitled to ILR even if I am no longer my husband’s family member?
Perhaps there are some refugee divorcees among us, thank you.

If you were already married prior to your husband being granted refugee status, there may be derivative status as a refugee (under family reunion).

Are you suffering domestic abuse?

No, no domestic abuse is involved.
If I stop being his family member, doesnt it mean I am no longer entitled to a refugee status? There will be no family.
We are both in the UK and had been married before coming to the UK and claiming asylum

Contact the refugee council (click) and let us know what they say.
