appeal allowed but ho appeal against ft decision

hello,
My appeal was allowed on 22 jan 2014 on Evidential Flexibility of missing information on bank letter.
i got letter from First Tribunal on 23 Jan 2014. i am very happy after long time but suddenly i got letter from ft on 31st jan 2014 stated that ho appeal to permission to the Upper tribunal on Ft decision.

Hi kkadia, can u please let us know what exactly letter said after, therefore I allowed this appeal?

the word on first tribunal letter:
the appeals are allowed to the limited extent that the respondents decision are not in accordance with the law and remain outstanding before the respondent awaiting lawful decision.

then after 31st jan 2014 get another letter from ft court:
HO try to challenge on decision to permission of the upper tribunal.

then 6 th feb 2014 got letter from tribunal:
the grounds of appeal are arguable and you have to wait for upper tribunal date.

evidence flexibility is not more apply on any cases.

only reason of appeal thrid parts declaration is not sign by applicants.

In this case you need to wait for the date and mean while just get all the documents ready. If possible prepare your self for any questions to answer and get the letter from third party declaration and sign. Have you got any solicitor? Business trading activities will help you in this case.

What were your main rejection points at the first place?

the main reasons are didnt sign third party declaration and bank letter didnt mention my name and money tranffered to uk.
but i submit bank letter and new declaration with all information in first tribunal . judge accept also but HO said that error in law.

now i am going upper tribunal with all documents.

Hi. I am in the same situation. My hearing was on 10th january.i got the allowed decision on 31th jannuary. We were so happy that after long time get the possitive result. Suddenly after 12 days got a letter that home office appeals against the decision and after that no news. Why they do this to our life? I want to die. I cant wait any more. What news about you? Do they review FTT decision? Please let me know what happened about your case.

hi i am more interested to know about it because i know its really hard for all of us i have got the same problem that bank didnt mention my name on it and other 3 grounds too you have a quick date 13 march just after 3 weeks may Allah bless you and make this hardness in to easiness. please let us know what does your lawyer says about it?

Hi kkadiya. When you recived the confarmation letter your appeal been grounded did they mention UT date on it or you had another letter?

Actually, judge review it and then decide to permission is granted. when we received letter for reason for ground against the decision then within 21 days they issue hearing date.

I been to the UT today hearing. I didn't get judgement yet. I have to wait 1 week more. boz Rodriguez evidential flexibility isn't apply more any cases. I don't know what judge decision. only one reason missing signature is still there.

I am wondering if you can help me with my case as I received judge decision he has allowed home office on the basis that I have not submitted one peace of evidence which is called NI2 contribution, Can you guys tell me in this case any law as home office never asked
me or call me before refusing that I have to submit this and I havent this.As I was assuming I dun have to submit this but unfortunately
I had to? Can you tell me anyone who won on this ... But by law I had to provide two peaces of Documents one i had provided but the second I missed? Anyone similar case?

In upper tribunal, judge mentioned only evidential flexibility no more apply after 22nd January 2014. Bcoz in court of appeal Rodriguez case overturned on evidential flexibility. So judge dismissed first tribunal appeal. Judge said you got all documents so apply again from back home. But this is my 9th year running so I m not going back but get to permission to the court of appeal and apply tier 4.
