Tier 1 (3 +2) - Second Extension

Tier 1 (3 +2) - Second Extension

Hi,

My Current status:

1. 1st Visa Stamped: 10-Feb-2010 ( for 3 Years - Till 10-Feb-2013)
2. 1st Extesion: 10-Feb-2013 (For 2 Years - Till 10-Feb-2015)

I came in UK on 20-April-2012 so I would be requiring 3rd Extension for 3 Years by 10-Feb-2015, if I have to make it for ILR. After going through various threads in this forum, I have found various cases where there has been inconsistency over the grant of 2nd Extension (2 Years or 3 Years) depending upon how the Case Worker interpret Rule 245CB.

My Query:

Is there any official UKBA Email or Postal Address from where we can have answer to above query: i.e. Duration of 2nd Extension for (3+2) Tier1 General Cases?

Kind advice is requested from Gurus / Modertaors please?

I do understand as it states in 245CB.

Period and conditions of grant

(a) Leave to remain will be granted for a period of 2 years, to an applicant who has, or was last granted, leave as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010.

(b) in all other cases, leave to remain will be granted for a period of 3 years.

Which suggests that ideally we should be getting 3 Years Extension; Since my last Leave to Remain was granted on 10-Feb-2013 for Two Years.

But my Query Remains:

Do we have any official UKBA Postal Address or Email Address from where we can have answer to above query? The reason for this particular query of mine is that we may have a written proof from UKBA to show it to case worker if needed be?

How long you can stay
You can extend or switch to a Tier 1 (General) visa for a maximum of 3 years if you applied for a Tier 1 (General) visa on or after 6 April 2010.

You can extend or switch to a Tier 1 (General) visa for a maximum of 2 years if you applied for any of the following visas before 6 April 2010:

further accrording to 245C

My last extension (1st extension) was based on the rule in place BEFORE 4 april 2010.

Is it possible for me to claim points under the rule in place AFTER 4 april 2010 in order to get 3-year extension for the 2nd extension?

Would greatly appreaciate your advices.

From the various prevoius experiences shared on this forum it can safely be assumed that many fellows have been granted 3 years on 2nd extension for Tier (3+2) case.

Also, many fellows have been granted 2 years extension under same circumstances but when they wrote to case workers decision was made to convert it to 3 years.

Moreover there are cases of granting 2 years extension under same circumstances but when they wrote to case workers decision was retained to 2 years.

It is inconsistent to say the least.

My Query:

I am also looking for the address and will ask them and that will be a clear guideline. Why don't they put the email address on the websites they maintain.

I have a question on Tier 1 General visa extn.
My visa issue date is Sep 28 2009 was valid till Sep 28 2012 – 3 years. Out of this I am able to utilise only 7 months, as I entered in UK on 27th Feb 2012)

I did 1st visa extension in Aug 2012, which is valid till Sep 2014 – 2 years

Now I need to go 2nd extension by Aug 2014 to get into ILR. So just wondering will I be getting for 2 years or 3 years extension this time. If 3 years then it’s good to do extension, else with 2 years now I need to go for another extension in March 2015.

Any idea on a same day appointment, most of people getting 3 years extension. do we know the PEO location such where case worker is not that hard.

Hi,
Ideally you should get 3yrs, But dont trust homeoffice guys. I am also similar timelines. But i applied my 2nd extension but they gave me 2 yrs. Now i wrote a letter to caseworker waiting for the decision. So duration was not consistent, It depends on the caseworkers wish. Hopefully my duration will rectified soon..

which PEO location?
visa extensions 3+2+? or 2+3+ ? (extended after April 2014)
If initially offered 2 years and you are able to appeal, and now got 3 years - few liners will be good.

Hello everyone,

My Tier 1 General visa expires in December this year. And I will be short of 3 months in December to complete 5 years condition for ILR since I came to the UK a bit late.

I have been granted (2 + 3) years on Tier 1 already. I called home office to find out if I can send application for a 2nd Tier 1 (General) extension. And I have got a mixed response. One said, no, Tier 1 is granted up to 5 years and no more than that, the other customer services representative said, since I am short of 3 months, I will get another 3 months extension. The impression I am getting from here is that I should get extension for another 2 years.

Does anyone know any home office policy regarding this?

Any help would be highly appreciated.
