Please Advise Me on which Form she need for applying.

2. My First Daughter was born in Mauritius, She came to UK when she was 3 months in 12 July 2004, now she is 10 years old and staying in UK for her past 9 Years 8 Months now, and her Dependant visa is expiry on 06 June 2014 (As she was on Tier 4 Dependent Before). I m a bit confused with all the New form for applying their stay in UK, (FLR M, FLR O, FLR TP, SET LR, SET O, SET M, MN1, Form T).
I will appreciate if you can help me. I have to make their application on the End of May 2014. Please reply me before May 2014.
Hi Farad,
Regards to your second daughter, you are right, she is born in this country so she apply straight for British passport through MN1 form.
With your wife and elder daughter as they both came to UK on the 12 of July 2004, so they will be eligible for their ILR on 10 years long residency bases on the 14th of June 2014,(considering them open to apply 28 days prior to the completion of their 10 years duration) which means they are 7 days short for being eligible to apply for their ILR and you need to cover that. What you need to do is to apply their FLR(M) application closer to the time of the expiry of their present visa and by the time the Home office deduct the fee and send them a letter to record their biometric details they would already be over the 14th of June and legally eligible to apply for their ILR. So at that point vary their applications to SET(LR) settlement application, and as you will be paying fee for the two different applications, you could ask the Home office at a later date to refund the fee for the first application. That is the cost effective and safe way to apply and get their ILR
Kind regards
Shahjee

Hi Shahjee, Thanks for your reply.
I was thinking about this idea and options. But my money is tied, I will do her and my first daughter on FLR M and I want to know if I need to show Maintenance for them £22000 for both. Can Me and My wife show our P60 to cover the Maintenance. Because my annum earning is £15000.00 a year + My wife earning is £15000.00 and its make £30000.00. And after saving some money I will apply for her Long Residents next year. Please reply me on that.

For my second daughter I will do MNI.

Please I will apperciate for your reply.

Hello everybody, i got my ilr on 10 years basis and my wife got her flrm before 6 april (she was my pbs dependent before 2012). Today she had an appointment for her setm in sheffield peo. The whole appointment went very smooth, no ques at all and at the end she was granted indefinite leave. For english requirement, she submitted expiry ilets certificate and printouts from pbs calculator for her masters degree done in her own country. So those who have got or applied flrm before 6 april under part 8 ( means dependent before july2012) can straightway apply for setm. Wish u best of luck for everybody.

Hi Farad,
I would advise you to check FLR(M) form, in that section 7 is the one to do with income requirement and maintenance. 7A begins by saying that if you are a PBS dependent prior to 09th July 2012, than you don't need to prove you income, and advises to go to section 7B (Maintenance). A lot of members are in consensus on that that due to the new rule change to the FLR(M) after 06th April 2014, this is bound to change and dependents have to prove income as well as maintenance, so watch for that as the forms are still a bit deceptive.
In you case as you said that you and your Mrs together make 30k an year and that you have P60's to prove that than I would advise for the safe side attach them along to make sure if they need any income requirement than that will be fulfilled as it is the household income which is considered, hence you and your Mrs can combine your incomes to meet the requirement.
The second part section 7B is to do with maintenance, means to say your incomings and out goings and your savings. Your incoming money should be in proportion to your out goings, means you shouldn't be spending more than you are earning, and it is better to show if you have any savings. You are trying to portray in this section that you have a stable family income and that you are fulfilling family requirements adequately, like rent/mortgage, general spending e.t.c.
So you understand that income requirement and maintenance are two different things and both are part of section 7.
I hope it helps. All the best for you forthcoming applications.

Hi Shahjee,

I am reading FLR(m) application and 7(a) does not say if u were PBS dependent. It says and I quote "If you were granted leave to enter or remain as a partner following an application made before the 9th July 2012 you are not required to complete section 7A, Proceed to 7B MAINTENANCE. For more information on completing the financial requirement section please see section 21 of the guidance notes."

Now on 6th of april HO office has changed the law and excluded PBS dependents to take that transitional route if the get ILR by long residency. We can check in Part 8 284 (c) as under.

284. The requirements for an extension of stay as the spouse or civil partner of a person
present and settled in the United Kingdom are that:

(i) the applicant has or was last granted limited leave to enter or remain in the United
Kingdom which meets the following requirements:

(a) The leave was given in accordance with any of the provisions of these Rules;
and

(b) The leave was granted for a period of 6 months or more, unless it was granted
as a fiancé(e) or proposed civil partner; and

(c) The leave was not as the spouse, civil partner, unmarried or same-sex partner
of a Relevant Points-Based System Migrant; and

So lets be very clear about it that any one applying FLR(m) after 6th april have to fill 7a.

Those switching after 6 April 2014 will have to meet the Financial Requirement under Appendix FM as per Annex FM 1.7 (section 7A on FLR(M)), regardless of when they were first granted PBS dep leave.

Hi all!
I got my ILR approval letter & docs yesterday, waiting for BRP. I wana ask you guys a question:

Currently I am at a college and semester is under way. Since I got this approval letter, I cant concentrate on anything because Its been too long since I seen my family and the only thing on my mind is to visit my parents for few weeks, as soon as I get my BRP. I am thinking about notifying the college about my status change as soon as I get my BRP, drop this on-going semester and resume studies when I come back.

The question I wana ask is that, do I need any-sort of holiday letter or document from college, to show on UK arrivals, when I return back from visiting my parents?

Thanks

Post by Ketu » Fri Apr 18, 2014 4:44 pm

I recently got my ILR at the basis of long residency. Now i wants to apply for my wife's Visa as spouse of settled person. I know I need to put FLR (M) application for her extension. She cam UK in 2007, but can i put "Set (M)" application soon after she got visa.
Second, what income in need to show for FLR (M) application.
