5 Years Employment ?

Hi There,

Just a quick question to confirm ?

Do you have to have 5 years of continues employment in order to get ILR ?

How about if someone was un-employed for a month in the last 5 years ?

if you are applying under Tier I General you have to qualified for the point base. It covers 12 out of 15 month of your application in which you have to provide all the documented proof related your job. It does not matter about any month(s) when you had no job.

I see there is a new rule that if you didnt have employement and left UK for few days then you will break 5 year continuity

looks like you need to be employed for all 5 yrs, But I guess Tier 1 was to allow ppl in UK without an offer and remain in UK unemployed as long as they are :

* Absent within 180 days in one calender yr
* Secure points based on 12 months earnings during extension and ILR


Key thing is case worker can refuse ILR on their discretion, if they feel that no evidences are produced.
Self explained letter is good enough when unemployed.

I agree with argus7 , as long as you are within 180 days or 90 days you should be ok . If you can just specify in the covering letter with the absence for those days with the Date of Departure and Return from UK with the reason of absence and with the evidence like passport stamp or e-ticket should be ok. Problem might arise only when you are out of UK more than 180 days in a year or continueous 90 days out of UK then you are breaking the continuity then case worker will look into it and asks for more documents otherwise you should be ok .
