Letter From CAPITA ON behalf of Home Office

I need help. We applied for indefinite leave to remain in 2010 as overstayer under article 8 and was refused. We requested for reconsideration since Jan 2012. My first son is now 7yrs + . I received a letter from CAPITA on behalf of Home Office this morning asking me if there are changes in circumstances and to fill some form and return to them within 14 days. We Son is now 7 years. Can this be added to the form as change of circumstances. Please I need advice.

There really isn't enough information here to offer any advice.

You should be asking your solicitor!

Hello Spring 2014.
Thanks for your reply. Please kindly advice me about this letter and what should I do? We have already completed the form attached to this letter and return to CAPITA. What do you think will happen now. Our application under the 7 years child rule was also refused in Feb 2014 and rejected as the main applicant was our son who is 7 years +. His claim was refused and the rest of the family as dependent rejected. The only surprising our fee of £2300 has be refunded. We just received the cheque of £2300 from Home Office this morning.

We have just submitted Pre-Action Protocol to the Home Office since last week. We are also surprised with the refund.

When you applied under 7 year child rules? or you talking about reconsideration request on January 2012 only. So your 5 applicant fee is £2300.00. When did you applied? when your application refused? My 7 year child application refused on aug 2013 which I applied on sept 2012 and sent reconsideration request on 4th September 2013 nothing reply from home office yet. In January 2013 my child got a british citizenship and again sent further letter on 5th feb 2014 stating home office urge to grant our stay because our child is british now but no reply yet. Just waiting.

First applied under Private life in 2010. My Son wasn't 7 year at this application, and was refused and we requested for reconsideration in 2011/2012 and only received this letter from CAPITA in 2014. Although we made a fresh application in Feb 2014 as my son turned 7 years in Nov 2013 and was refused before we now received the attached letter from CAPITA in March. The refund of £2300 was the fee for the application we made in Feb 2014 using the FLR(FP).

I think this is the positive move from home office. They just refund your new application fees and want to reconsider your previous reconsider request. What your solicitor saying? did you contact your solicitor?

We have replied CAPITA and completed the enclosed form and returned to them. Just waiting for their response.

I think you have a strong case, your all three child born and brought up here in uk, there home is only uk, how comes home office ignore. They just playing the games. Don't worry your stay is round the corner only stay away with the any criminal conviction. Best of luck.

Hello Paul,sorry have been away but to my understanding its a good sign.I got this same letter through my solicitor in February 2014 which I filled and returned to him,then he checked then sent it to the Horror Office.After that on the 4th of April 2014 I got an IS75 one stop warning and IS76 statement of additional grounds which I have to respond to in 10 working days these letters was sent to me directly by the immigration enforcement not my Solicitor office.I rang my solicitor to tell him he says i don't have to do anything about that they had everything they needed to decide the case already with them,that got me worried but i trusted my Solicitor so I tried to calm myself down.On the 8th of April got another letter sent to me directly by Horror Office IS96 which is temporary admission to a person liable to detention and must report at Police station of Easter Monday.
Again on the 17th I received a call from my Solicitor that I got a free biometric letter which he sent to me i got it late Saturday couldn't do it same day had to waited till Tuesday because of the bank holiday Easter Monday.Also I attended for the signing on Easter no one was there,I had to go to the Police HQ just for record purpose.Biometric done on Tuesday after Easter Monday.Fingers and toes crossed for now. :lol: :lol: :lol: :D.

Timeline 1st Application 2010 Private life :refused
2nd Application 2011 as British parent: Refused
Reconsideration July 2011
Mp involved September 2013
Review letter and question form Capita 4 Feb 2014
Is75 & is76 4 April 2014
Is96 8 April 2014
Free Biometric 14 April

@ Shondra,I will advice you put in a fresh application now,since your daughter is now a British citizen instead of waiting for your reconsideration request because you put in your request after November 2012 when it was changed by the Horror office.The Horror office can never be predicted too,but for how long would you want to wait that is up to you :?: :?: .Common girl :!: :!: you need your life back summer is around the corner.
