You can either extend then vary if a decision is not made or apply relying on AQ(Pakistan). It's up to you. Don't expect others to tell you what to do.

I have been in UK for 9 years and 5 months, JR in process, all appeal right have been exhausted ? If before hearing I complete 10 years, then can I apply for ILR?

JR does not extend your LTR. If JR fails then you will be (are now) an overstayer since your last IAT appeal was dismissed.

Can I get a link to the FLR(FP) or FLR(O) recent process time on the skydrive please, so that I can assess the duration.

Thanks

I want to clarify my matter here please help me if have a minute form your great time.

I am 7 days short for my 10 year long residency. How can I avoid this 7 days?

Should I use FLR(FP) and vary the application in 7 days? is there any better option???
How do I vary the application ? I event got any idea.. Just sending a letter to HO ?
Do I still have to complete SET(LR) with the variation?

PLEASE ADVISE. THANK YOU

You can apply from 28 days before 04 October 2014 so you don't have a problem.

Hi Amber,
Thank you for the reply but rule says that you need to have valid visa for 10 years before apply in 28days . and i havent got visa until 4th oct..
can they refuse my application because of i have applied 7 days early. By the time i apply I will be 7 days short of valid visa to complete the lawful residence.

will the caseworker consider the date of application or date which he or she make the decision?

Please advise
Thank you

hi Amber,
I think I got your point.

on the guidance it says

(Applications received 28 days or less before the required qualifying period is completed
You can grant if an application if it is received 28 days or less before the applicant completes the required qualifying period, provided they meet all the other rules for long residence._)

am i right?

Thank you

Can you please advise on the best option to take.

1- apply for LTR on basis of private life ( FLR(O) or FLR(LR) ). Appeal if refused.

2- apply for ILR on basis of long residency ( SET(O) or SET(LR) ) even if 10 years not complete and rely on discretion. Appeal if refused.

option 1 gives me a VERY SMALL HOPE of possibly being granted FLR after possibly 1 or 2 months (as my understanding is that FLR application are processed quicker these days), so that I could travel and work.
option 2 might potentially be less expensive than option 1, but definitely no passport for at least 5 months I guess.

Please tell me what u think would be the best option.

What's the update on your case @Ojey? Which option did you go for?

ILR and dependent application form

Post by thisam » Thu Jul 03, 2014 5:13 pm

Dear members,
I am willing to apply for ILR on the basis on 10 year long residency. currently I am on PSW.
I will complete 10 years in Sept 2014 and my current visa runs out just before I apply as I am 7 days short to complete 10 years.
According to the rule i can apply 28 days before and therefore i am in the safe side.
My dependent (psw dependent) is in UK for 2 years and her visa runs out on the same day.
my question is what form she should use ?
this is grey area between set M and FLR (FP) . what rule will be relevant to in this case . she will have to apply on the same day i apply.

Please kindly share your knowledge and experience. I hope you all the very best
Thank you

Dear members,
I have got my PR today. I would like to thank all members who helped me especially AMBER , VINNY . Thank you for the support. Without you guys I couldnt even think of what I should do. I managed to apply by myself without getting support of solicitors who told me different stories. You all deserve the credit for my success.
Wish you have a great day and wish you all the best for your everyday success.
