When can my wife apply for ILR?

When can my wife apply for ILR?

Hi,

I am currently on a tier 1 (general) visa and should be eligible (ideally) to apply for ILR in March 2015.

My wife first entered the UK in October 2011 (on a Tier 1 Dependent visa). Her visa was issued till December 2012. However, she was here only for 6 months before she went back to India for her delivery. Her visa expired in December 2012. She reapplied in March for a Tier 1 dependent visa (along with our daughter) in India and got it in April 2013. She came back to the UK at the end of April 2013 and has been here ever since.

My question is whether she has to be in the UK for 5 years (according to the new rules) before she can apply for her ILR? or if she can apply for ILR after 2 years in the UK?

When will our 1.5 year old daughter be eligible to apply for her ILR?

My query is similar but little different story,

I was granted Tier-1 General in June 2009. My Wife came to UK as PBS Tier-1 General dependent in Dec 2009 and she spent time in the UK continuously till Sept 2012 (2 years 10 months approx.) We got Tier-1 Extension in May 2012. She went to India for her delivery in September 2012 and returned to UK along with our child in April 2013.

I have got Cohabitation letter from the time she is in the UK until this point of time. We got her NHS letters, bank statements, phone bills, employment proof in the UK etc.

Just want to know whether her ILR will go through without any trouble or not. Am I being overcautious or silly?

If the leave expires and you apply for fresh EC as a PBS dep after July 2012, you'll be subject to 5 years.

The aviator, you should be fine.
