EEA 3 and EEA4

Hello all, I will be grateful if somebody can advice me on my situation.

-I am non EU married to Polish wife in March 2009. Has eea2 till September 2014
- My wife did exercise treaty rights since August 2004 till February 2014 in this country.
- Our baby is British national. (due to wife papers)
- She did resign from job in month of February 2014 because baby is too small and wish to be looking after him for another 2 years till he can go school and she will look for part time job.

questions:

1- what is the quickest way we both can get British citizenship?
2- do i have to go eea4 route for British citizenship?
3- she is currently not working. would it affect her eea3 application?
4- in eea3 and eea4 form asking for Time spent outside UK- honestly she traveled few times (to Poland) but never been away more than 2 months in a year. Dont remember all travels.tried to look into flight bookings but could find only few records. would it affect her EEA3 application if we fail to declare all travels to Poland (coz they dont stamp anything so cant keep record)

Since your wife is an EEA citizen, your child will be a British citizen at birth if she is a permanent resident. So HOME OFFICE already satisfied that she does qualify otherwise child will not have passport. So, your EEA family member can apply for BC now after she is issued BC you can also apply.

there is a loophole that allow spouse of a British citizen don't need to wait 1 year after PR if they already lived in this country more then 3 years. So your can also apply BC after 5 years 1 day as an EEA family member

- All the documents that you send for your baby British Passport
- WRS scheme certificate ( if your Wife is from A8 countries )


Basically you have to show 5 years her work history continuously . It can start from 2004 to 2009 and 1 year PR. But PR is not a requirement so one can apply British Citizenship without PR
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

1-are you saying/suggesting we both can apply for British Citizenship together without me waiting for eea4 + 1 year?.

2-I heard if we both apply together it will be cheaper for citizenship?

You can apply BC March 2014 only If your wife was already a British national. If she is not you can't
so at this moment only she can apply not you.
after her British Citizenship confirmed then you don't need to wait 1 year after PR. You can apply 1 day after you qualify for PR

So if the eea granted british citizen so the non eea can granted british citizen after 5 years without applying for eea4 ?

Hello guys,

After giving a lot of thought I applied for my wife's EEA3 (PR) card.

Papers are sent on Friday 14/03/2014.

Documents submitted:

1.passport
2. photos
3.p60s- 2005/06/07/08-09/10/11/12/13
4.wage slips- 2013-14
5.WRS certificates (she had 2)
6.bank statements from 2009 begining till today
7.rent contract (2008) as bank statements were missing i thought this will cover residence proof
8. employers reference letter (this is 1st eemployer when she came to UK and completed 1 year on WRS.
9. covering letter regarding TIME SPENT OUTSIDE UK - as she had few short trips outside UK which we cant remember.

Opinions are welcome on this and I will keep all posted regarding progress for this application.

Hello Guys,

My partner EEA3/ Permanent Resident stamp is arrived yesterday 29/04/14 (was submitted on 14/03/14). So was a month and a half not bad.

Now i will be submitting EEA4 and will see how it goes.

Once again thanking all for your thoughts and help. surely update you on progress.
