worker status and eea4

Post by poltrade » Sat Jun 21, 2014 2:23 pm

I been working from 2006 till.now for one company
full time
but this year the last few month lets say around 4 month
I reduced my hour so some time I work 6 hour aweek
some week 12 some week no hour
and I think I need another 6 month or so to apply
for my eea4 on my owen so do you think this
peried of shorteness hour can effect my eea4 and loose
my worker statues .
but from today I went again full time for the same company

Were you still under contract for the 4 months? Were you still entitled to paid sick leave and holiday leave? Were you still registered on PAYE? If so, your work had all the indications of "genuine and effective" work, which means you retain worker status.

I assume you are Non EEA national and going to apply EEA 4.
In this case your work does not matter, only your EEA national partner or spouse economic actives acceptable in the form of treaty rights.

I may be wrong but I assume by your username that you are Polish? If that is the case it's EEA3 that you apply for and not EEA4 as that is for non-EU family members of EU citizens.

Since you were still on a proper contract, then you have nothing to worry about when applying for your EEA3.

By the way, if your vocational training as a barber was related to your current job, you would retain "worker status" anyway even if you had given up your job entirely.

Don't worry about those six weeks.this will not effect on your PR application unless you claim any public funds.
