I am non-eea spouse of a british national. we want to relocate to ireland on the directive of EU-free movement. i have a criminal conviction in the uk for 8months and told to leave the uk because i was an overstayer. i left the uk on administrative removal. is this going to affect me at the ireland embassy if i apply based on the Directive 2004/38/EC to join my uk national wife in ireland

I'm sorry but I don't know the answer. You should probably consult with an immigration law specialist. If you can't do that, though, I think the best thing to do is get the form (the EU1 form) you'll need to apply for a residence card here in Ireland based on your spouse's UK nationality (a Stamp 4 EUFAM) and see whether it asks you about overstaying or about criminal convictions. I just don't remember from when I filled it out. Keep in mind that when I got my Stamp 4 they fingerprinted me so if this stuff is on your record, I bet they'll find out, whether you tell them or not. Good luck!

Thanks to all the posters for sharing. I was hoping someone could check over my logic and steps below and see if we are on the right track.

I am a South African, my wife holds a British Passport currently working as a medical doctor in London. We are moving to Dublin end of August 2015, I do not need a visa to enter (so get the 3 months on arrival).

The next steps from what I have researched and reading through forums.

1 - Get PPS number as soon as we get there
2 - Submit EU 1 application form
3 - Go to INIS for temporary Stamp 4
4 - If application is granted, go to GNIB for Stamp 4 EUFam

Does that look right?

Any comments / feedback would be greatly appreciated.
