Hi all,
I had got my Tier 1 visa in July 2010 and entered the UK in September 2010 for 2 weeks for job interviews. I had then gone back to India and relocated with my family in second week of November with 49 days absence.
Since then I have been working in the UK as a Director of my Limited Company, and have traveled outside the country on vacations or family relevant issues.
I had got my extension in 2012 and got the extended visa till Oct 2015.
My absences have been like this:
Year 1 - 80 days - Sept 2010 - Sept 2011 (from first entry)
Year 2 - 29 days - Sept 2011 - Sept 2012 (working from India)
Year 3 - 51 days - Sept 2012 - Sept 2013 (Vacation + Working from India)
Year 4 - 24 days - Sept 2013 - Sept 2014 (Ongoing, no plans to travel outside UK)
Year 5 - Ongoing - Sept 2014 - Sept 2015 (Planned 20 days in Dec 2014)
I have a few questions in regards to my ILR application.
1. Can I apply for ILR in September 2015 based on my first entry being Sept 2010, and my current visa valid till Oct 2015?
2. Does the initial absence of 49 days (for resigning from old job and relocation) affect the ILR? How should it be shown on the absence template.
3. During some of my absences, I was working from India for my UK client and getting my invoices paid in the UK for the same. Can this be classed as Work travel?
As per these scenarios, do I need to get my visa extended before 6th April 2015 (since it closes after that), or I can easily apply for my ILR in September 2015.
