War in Ukraine - Student wants to claim assylum

I'm posting on behalf of said student.

Student is legally in the UK on a student visa studying English.

His country is calling up all reserves up to age 40, he is 20.

His parents do not want him dead!

Can he apply for asylum?

If yes, what is the first step?

Will he get carted off to a detention centre or will he be allowed to stay with a host family who will cover all his living expenses while his case is heard.

How long can all this take for a yea or nay?

If he's studying and on student visa he can stay on that can't he?

Claiming asylum because of the call-up isn't valid grounds in my opinion, otherwise everyone in Russia aged 18 to 28 would be claiming....

Hello Wanderer,

Lord Lucan here.

His visa is a rather short term one, a three month intensive English language course and this runs out in around one month from now.

So, in what circumstance could he claim asylum as I thought conflict at home was one such instance?

Somalia, Sudan, Syria, Afghanistan, Iraq all come to mind, ending up in Wembley.

Does any of this apply?
To be recognised as a refugee, you must:

have left the country you’re a national of or, if you’re stateless, the country you usually live in
be unable to go back because you fear persecution
be unable to live safely in another part of the country you left
have failed to get protection from authorities in the country you left
This persecution must be because of your:

race
religion
nationality
political opinion
membership of a particular social group that puts you at risk because of the social, cultural, religious or political situation in your country - eg your gender, gender identity, sexual orientation
Some points from me:

1. There is no war declared in Ukraine yet so far as I know.

2. I have friends in Kiev, things are tough but there is no fighting there or Westwards.

3. Joining the Army is a local issue, in fact it's the lads duty as a Ukrainian, tough, but not an asylum claim IMHO...

You make all valid points.

He has just been told this.

If I were him and decided for whatever reason I did not wish to do military service I'd either become a monk or a cross-dresser.

That I'm sure would sort the issue.

If they were at war then I'd become a conscientious objector.

In Russia it was common to 'accidentally' lose your trigger finger but they even take those now. Lot's avoid it in the usual post-Soviet way, bribing the Doctor for a note basically saying you are mental/mad whilst others at uni were still conscripted but didn't serve as it was decided their brains weren't worth risking.

My partners brother avoided it by basically hiding every time they came for him!

I'd suggest the doctors note is the most common/viable, and if his parents have money as it seems, they are probably aware of this.
