Filing a new application for ILR while appeal is in progress

Dear Gurus,
I was refused ILR and I have appealed the case.
I have exhausted my 5 yr leave under Tier 1. But I can stay here as the appeal is in progress...
In the meanwhile if I reach the salary level required to get ILR (32000/- gross) can I file a new ILR application?
(I dont have to depend on the appeal decision,... this is a totally new period after the date of refusal)
Does anyone know about this? Pls help
