Hi,

I have a query , i came to the UK in 2010 , i completed my undergraduate at Coventry University in 2013 after this i enrolled at Uni of Bham for my MSc course which was from sep 2013 till Sep 2014. I further want to do MBA which is for 24 months including 12 months paid internship.

I am aware that i will be making an academic progression as i am moving from masters to MBA what i am concerned about is, will the MBA be included in the 5 year cap? As it is at NQF level 9.

Will i be able to obtain a visa for MBA?

This says that the highest level is NQF 8 and thats for PhDs etc : https://www.gov.uk/what-different-quali ... evels-mean

So not sure about your NQF 9, maybe you should check with the course provider.

Also an MBA is a Masters (Business Administration) so you appear to be wanting to do a second masters, so it would seem its not automatically academic progression.

I studied 4 years of Bachelors degree.
After that I was on Psw for 2 years.
11 September 2013 to 5 September 2014 is the duration of the my masters degree in Software engineering, which is in progress.
My visa finishes on 5th November. But my dissertation project submission deadline has been extended to 27 Nov 2014.
I know I can apply for extension on ground of dissertation write-up. I apply for extension hope full I will get a visa for the duration of write up plus four months. My question is, can I apply for the tier 4 visa or the 5 years cap wont allow me to do that? Could anyone please help me with this question.

PSW: switched from student visa to PSW.
Msc in Software engineering: switched to tier 4, duration 11 September 2013 to 5 September 2014

PSW: switched from student visa to PSW.
Msc in Software engineering: switched to tier 4, duration 11 September 2013 to 5 September 2014 extended to 27 Nov 14 = 1 years and 2 months

Total 4 years and 11 months spent studying at degree/masters level. I think the only option now would be a PhD which is exempt from the 5 year cap.

I am planning to apply for MBA after my Msc.
Did you get through? as I am not sure if this is academic progression.
Please advise

Can someone please help me calculating the cap, HO is trying hard to kick me out depriving me off my legal rights and even without considering their own mistake.

Feb 2011 to Nov 2012 (Entry Clearance student visa)
Nov 2012 applied for student visa extension and got refused, against which I applied for JR which ran upto 9 months. Finally, I received my Visa on Dec-2013 until May-2014.
May 2014 to Aug 2015 - (To finish my current education)
Aug 2015 applied for student visa extension and got refused on the ground that my new course of 12 months will take me beyond 5 years.[/quote]

Following the refusal, Eaton House Officer is eager to snatch my rights and kick me out of the country, even when they are aware of my legal rights under section 3C & 3D.

Practically I have 6-7 months to get to the cap of 5 years and the loss of 9 months (during which I wasn't student being deferred) which totally comes to approx 15-16 months.

I have applied for JR, which is on the way, I need some legal guidance in terms of section that would help me further, to claim my loss of 9 months during which I was neither on Tier 4 nor I was studying as my university submitted deferment form.

Also, I entered into the country in Feb-2011, so the rule of 5 year can't be applied retrospectively to me.

Please help.

sorry to interfere here...

from 11 September 2013 to 27 Nov 2014 is "1 year 2 months"? Can I please know how the calculation is done?
