Tier 1 General Extension and ILR

Hi,
Need some help regarding Tier 1 General visa extension and ILR application.

I got my Tier 1 on 16/08/2010 for 2 year. Then went for extension and got it for 3 year which is valid until 16/08/2015. I had came to UK on 11/Dec/2010 which is more than 90 days from visa start date.

1. Can I go for ILR visa directly or need to go for another extension on 16/08/2015 due to 90 days rule?

2. I have heard that we need to apply to extend our leave to remain before 6th april 2015? is it true?

Please advise what i need to do.

1. You have to be in the country for 5 years to qualify for ILR. 90 day rule is that you get grace period of 90 days for coming in late after your initial visa. Since you came in late, that rule will not apply to you, so your qualifying period will start from 11/12/2010.

2. It is True. You will need to apply for extension before 6th April, 2015. There is no alternative.

I have got a similar problem

First visa applied 3rd May, 2010. Visa stamped 25 May 2010. Visa received 8th August, 2010. Travelled to Uk on 11th Sep, 2010

The delay happened from UKBA side which they had acknowledged in an email when I had asked them about delay.

| have got that on record with me.

I went for first extension in 2012 and now my current visa expires on 25th May, 2015. So this means I did not come within 90 days of grant of visa but after that.

The questions is would UKBA consider this fact that the delay was from their side .

I am planning to do a postal application in May, 2015 for ILR ,. By the time they decide the applicaton it will be already 5 years to me in UK.
Can I do that. Does my approach look sensible.
