FLO ENQUIRY

Dear Moderators,

My husband is here on 2 years family visit visa. I will like to know if he can apply under discretionary leave rules due to compelling and compassionate circumstances. He would have applied for spouse outside the UK but due to the not meeting the financial requirement. We also have 8 months old baby.

If yes, which form are we filling?

Well you husband cannot qualify as he is on a visitors visa.

Perhaps he may qualify if his leave as a visitor expires, but not when it is valid.

What is the compelling reason?

1. I had medical complications and am on indefinite DLA.
2. Am suffering depression
3. Am grieving for the death of my mum since January 2014, two weeks after giving birth.

Well you can give an application a go, or wait until he has overstayed his visitors visa.

Was it ever stated he's got a wife before getting the visitor's visa?if you've never stated this, I think it will be difficult if he should overstay his visa.
If you're on DLA he can still apply from his home country without overstaying his visa which can really make things longer than you're planning to do.
Just my little advice.

The visa was granted for visiting wife and kids. The problems of getting visa outside uk is too tough and difficult. It csn take upto one yr.thanks

Well,the route you're planning to take too will take almost the same and he can't even work or do anything important.
It's just an advice, nothing stops you doing it the best way you feel.
