ILR: Out of UK for more than 180 days due to work

Post by UKILR1973 » Sat Aug 23, 2014 6:29 pm

Dear members,
Appreciate your valuable feedback to give clarity to my case.

Background:
I arrived in UK through an Tier 2 (ICT) in Feb 2010 and moved into Tier 1 (General) in Aug2010. So, I am due for ILR in Feb 2015. Except in 2013, rest of the years I was away from UK for not more than 75 days. In the year 2013, my company send me to Singapore for an assignment for 1 year from 1st Jan 2013 till 8th Dec 2014. I have letter from my employer to this effect stating clearly the same. In the year 2013, i visited UK for 8 days only in May 2013. My salary was paid in UK bank account and had my rented house and car as well here. I am single.

Query:
1. Will the long period of absence in 2013 affect my ILR application?
2. If yes, what options do I have to make it successful? or it is not at all possible to make it through and I can only go for 1 last extension in Feb or April 15.

Cheers

As you absence exceeded 180 days that will have broke the continuous residence period, employment related absences are not a valid reason I'm afraid. You'll have to see what date you can use as the start date where absences in each 2 month period do not exceed 180 days.

Moderator, Thanks for your response.

In this case, I can apply for an extension in Mar15? I got last time 3 years extension (in Aug2012). So, can i say i could get 2 years extension? Any possibility they could give another 3 years?

Cheers

Yes but it must be by April 2015 when the rules changes.

If you provide all the details, we can split 180 days to different years. so that you can go ILR same time. But i need following details.

Your Visa start date, your UK start date, And all absences start date and end date. So that i can calculate for you.

Suresh

Hi Suresh,

You mentioned that you will split 180 days in different years? How is it possible? For example, I stayed more than 180 days outside UK (Nov 29,2009-Feb,5 2010)and wanted to apply for ILR. How could you make it possible? Please reply. Thank you.
