ILR applying date query

Hi,

I have 2 queries on my ILR application date:

Below are the main dates related to immigration –

20th Nov 2009 – Tier 2 ICT Visa got stamped.
15th Dec 2009 – Entry to UK
31st Dec 2012 – Got Tier 2 ICT converted to Tier 2 General Visa - granted ( No Breaks in Visa ) till Jan 28th 2016

Can you please clarify this

1. Do i become eligible for ILR from 23rd October which is 28 days before 20th Nov 2009 when my Tier 2 ICT Visa got stamped or after 17th Nov 2014 which is 28 days before the complete of 5 years stay in UK & where should I mention this date on the application form?
2. Also I have in total 163 days out of UK and around 40 odd days per year, Can I be out of UK for just 17 more days till I get ILR or its 180 days in a calendar year?

You will qualify 28 days before the 20th November 2014.

You have not broken your continuity of residence.

It is 180 days in your calendar year, which in your case start from 20th November 2009

I have couple of more questions regarding the above response -
1. Will I have to mention the time period between 20 Nov - 15th Dec as being absent from UK and what would be the justification I would need to provide. And will this be counted as the number of days absent out of UK.
2. What is the date which I need to mention on 6.1 section of Set O form. IT says - When did you first enter the UK ? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this applicaiton is based ? Should I mention 15th Dec or 20th Nov. And if I mention 15th Dec, it might consider me eligible 28 days before 15th Dec.
