ILR date Query

Hi Guys,

I need a clarification on ILR process.

Does the UK paid leaves will break the continuous period for ILR. I have 189 days gap in one year and in that 24 days are UK paid leaves outside UK and the remaining days I spent in India for the same Employer to work for the same customer from there. So with the letter from Employer for the 24 UK paid leave and considering the remaining days are also associated to the same Employment, will i be ELIGIBLE for applying the ILR.

If not I will have to wait for one more year to fulfil this.

I will appreciate your response on this matter.

Alter the date of application so that in each 12 month period absences are 180 days or less.

Following Ambers comment, read the calculating continous period for ILR document from the UKVI site to see an example of how to do this.

Hi All,

Thanks for your reply. I have gone through the UKBA calculating continuous period for ILR document.

I will be eligible for ILR in Nov'2014 itself. However I will have to wait until May'2015 to avoid the 180 days Gap in my first year in UK.
Hence my 5 years split would be for ex:

20-May-2014 - 20-May-2015
20-May-2013 - 20-May-2014
20-May-2012 - 20-May-2013 (In this year only I have 189 days gap in one year and in that 24 days are UK paid leaves outside UK and the remaining days I spent in India for the same Employer to work for the same customer from there. 20-May-2011 - 20-May-2012
20-May-2010 - 20-May-2011 (175 Days Gap in offshore, this is also connected to same Employer/ Employment, No annual leaves)

If not I will have to wait for another 6 months or more more to fulfil this. Let me know if the exact dates will help I shall provide the same

You cannot have more than 180 days absence in each 12 month period!

Alter the dates!
