Doing taxi on tier 1 entrepreneur

Post by rahil_dk » Mon Sep 01, 2014 6:26 pm

Hi every one,

Just wanted to ask all, are we allowed to do minicab/taxi on this visa if we register a minicab company in our name ?

And can we do any other business below graduate level ?

Waiting for your comments. Thanks

What sort of question is this bro????

Come correct next time. of course you have to do graduate level stuff unless you are a business manager where you manage a fleet.

running a taxi Business and working as a taxi driver have specifically been mentioned as barred profession in policy under 50K route, and you should not be doing any other business either which is lower than an acceptable level under 50K route.

If you are applying for Tier1 Enterp. visa under 50K route; this business IS NOT ACCEPTABLE. Even you cannot show yourself Business Development Manager in Mini Cab business. i.e. You cannot show yourself at Level 6 profession under Level 3 category of business. Guidance policy is quite clear on it.

However it is not clear from Guidance Policy that after getting visa OR during your Tier1 Enterp. of 50K route: Can you do any secondary/part-time business below level 4 business OR not ? It is still debatable that without using any proportion of assigned investment for actual level 4 or above business whether one can do secondary/part-time business under level 4 or not.

Hi,

its a confusion, restriction of NQF level 4 profession & business for initial application or for extension, therefore till now there is no restriction / requirement for extension, but on the safe side, I would say doesn't matter if you created NQF level 4 above profession in taxi field, but it self cabbing is level 4 below activity, so its not acceptable, your business activity has to be level 4 or above.

Just got this reply from home office.... What i get from it we can not do taxi on tier 1.... !
From: DMC (Croydon)
Home Office

10 September 2014

Dear Sir/Madam,

Thank you for your email correspondence of 29 August.

Please refer to point A41 on page 49 of the Tier 1 (Entrepreneur) guidance
which states:

“If you are granted leave to enter or remain as Tier 1 (Entrepreneur)
migrant, your leave will

prohibit you from engaging in employment except where you are working for
the business which

you have established, joined or taken over. You will comply with this
restriction if, for example, you

are employed as the director of the business in which you have invested,
or if you are working in a

genuinely self-employed capacity. In this capacity you will have a contact
for service.

You may not, however, be considered to be working for your own business if
the work you

undertake amounts to no more than employment by another business (for
example, where

your work amounts to no more than the filling of a position or vacancy
with, or the hire of your

labour to, that business, including where it is undertaken through
engagement with a recruitment

or employment agency). In this capacity you would have a contact of
service. This applies even if

it is claimed that such work is undertaken on a self-employed basis.

In considering whether your work amounts to genuine self-employment (and
is therefore work for

the business which you have established, joined or taken over) or is in
fact employment

by another business, we will take into consideration the factors set out
at:

[1]www.hmrc.gov.uk/employment-status/index.htm#1.

If your work amounts to no more than employment by another business, we
may consider you to

be working in breach of your conditions of stay, and that you are
therefore liable to curtailment of

your stay and/or removal from the United Kingdom.”

I hope this information is helpful.

Yours faithfully,

Mo Martins

Hi Rahil

I have a couple of questions regarding Tier 1 Entrepreneur Extension that I wish to ask the Home Office about. I cannot, however, find an email address for them. I can see that you emailed them and received a reply back. Would you mind letting me have their email address please?

I have tried sending you a private message but it is not going through for some reason.

your help is appreciated.

What I get from it and already knew is that you certainly cannot do taxi on a Tier 1 visa. However nothing is stopping you from starting a cab business. What it states in simple words is that if your services are hired by a single company which tantamount to employment, is not allowed under Tier 1 and understandably so.

Thanks, appreciate your help.

I am basically trying to find out if I can purchase a commercial property under £50k route. My business is registered as management consultancy firm and I was hoping to invest £50k in an office to meet the requirements, but I have been told by a few people that under £50k route, I cannot invest in a commercial property. Not sure what to do as cannot think of other ways of showing investment of £50k in a consultancy business! any thoughts?
