@sintiaatm, my refusal was on 2 points 1. I didnt provided degree certificate 2. Marketing material is not enough to understand the nature of business. They didn't understood what business actually company does.

1. Regarding 1st point unfortunately solicitor missed to put degree certificate.

2. We did provided business cards and website.

We come over with the arguments. And finally judge allowed but they raised issue again. So will c what happens next.

I am thinking to call them again to ask if any decision has been taken Or not.

called them today, just right before they close their offices and still decision hasnt been taken. Now 2 weeks left in completing 6 weeks time for judge to decide the request from HO. so lets wait and c.

And in my case 1 week left to completing 6 weeks

I can c their effectiveness. anyways I will call them next week thursday and will c if there is any updates. mean while will keep updating if I will hear anything. good luck mate to you as you will be completing 6 weeks time frame next week.

They are absolutely doing non senceness as in the first place they dint attend
in the first tribunal appeal and now they are appealing against judge decision its
like a waste of time and money for me and distress.

There is no one who can stop them in doing so as its not right if you clearly
win the appeal whats the point of taking it longer they are just being pai now
doing this deliberately to everyone..

My mum is severely ill and I urgently wanted to travel back home but I do not understand what
to do IF something happens to my mother who will be liable for it as she is refusing to undergo
any treatment without seing me am so upset.

you know this is their tricks it happens to me they did not attended the FTT and now they have challneged it and my barrister said
whatever you do and if you ask for UT permission they will never grant it to u but if HO will ask they will definitely grant the permission to them so i have my hearing on first week of april now......as my decision is been challenged by them and they have been granted the permission. you know we have to do sabbar and we wil insha Allah clear it. may Allah gives health to your mother. aameen.

I have seen in some cases Applicant had kept chasing them by calling to HO writing about emergencies so they can speed up the process. You can do that too kassy1.

I am wondering if you can help me with my case as I received judge decision he has allowed home office on the basis that I have not submitted one peace of evidence which is called NI2 contribution, Can you guys tell me in this case any law as home office never asked
me or call me before refusing that I have to submit this and I havent this.As I was assuming I dun have to submit this but unfortunately
I had to? Can you tell me anyone who won on this ... But by law I had to provide two peaces of Documents one i had provided but the second I missed? Anyone similar case?

hi guys been reading through the forum and seeing that there is a trend of homeoffice pushing for new application and things so any body knows whats the rules for new application would be like the new application states that we should have people employed under us etc ?..

my application was on nov 2012
refused may 2013 grounds of supplier email id not on contract and not a proper contract with legal terms
secondly on no advertisement (had advtstment but was overlooked)
went to appeal court in january ..judge said i won but also criticised saying i have not had a fully run business Ho can ask for more documents but return his money for appeal and consider evidential flexibility ( this happened because ther was no homeoffice at the appeal)
HO went against it and have appealed on 31st january 2014

if someone could answer
has anybody asked for their passport and degree certificate back back from home office ?
if yes whats the best procedure to go about it ?

has anybody won cases at UTT if yes could u please state the clauses and reasons..would be of great help if someone could as i have next court date soon

judge dismissed the case in my favour. Alhumdulilah.

I applied with my team mate for tier 1 ent.. In jan 2013. We were refused by HO on genuine ent test. I won the appeal in FTT but UT said FTT judge erred the law by considering new evidence.
And UT judge set aside the FTT verdict.

Now i have to apply fresh application. I have few questions regarding that.

Can i apply using the same company or i need to register new company under my name? Cuz HO say company has to be registered in 3 months time before you apply. I am confused regarding to that.

I had two contracts under the previous company and both have been completed and money received in the business acc. And i also made investments from business acc as well.

So now my question is can we use tht investment for new application or not. I still have access to 50k... And itz in our personal joint account and it been there for more than a year now.

Please help me out, i will be really grateful to you guys.

No They did not. and they took no further action and now after such a long time, we are writing to them but they are not replying...

Guys my upper tribunal hearing is on Monday
Upper tribunal except the Ho appeal on two point
1. There is no fee in my contract
2. First tribunal except the new evidence
In my case the fee is clearly mention but instead of fee we use a word compensation in our contract

As far as new evidence is concern we submitted all the required documents
According to the policy we just give the new evidence regarding the new issues Ho raise in my refusal
