Early extensions

Post by Go12 » Fri May 09, 2014 11:02 am

Please can moderators, gurus can you all
Clarify whether we can go for early extensions or not.
This is getting too confusing, the ukba is as usual making things difficult and no clear signal about early extensions.what should ppl having a visa which expires in sept or dec 2015 ,and who need to go for 2nd extension do since there will be no extension after April 2015?what are their options, there are soo many rumours going on about 28 day rule.
Plz clarify
Thanks

I am not an expert or guru. But many of my friends went for extension 1 year before thier expiration. And also UKBA didn't mention anywhere like you can't extend you visa before 28 days. lets wait for the gurus coments on this.

Suresh

Similar problem here:
Tier 1 general (with 1 dependant)
Start date of first Tier 1 visa: Jan 2011
First entry to UK after the visa: May 2011 (silly me)
1st extension applied for: end 2012.
Current Tier 1 visa expiry date: Jan 2016.
But will not have lived in the UK for full 5 years under this visa by Jan 2016, so will need to apply for 2nd extension before that.
However, I just found out that no longer Tier 1 extensions will be accepted after April 2015!
So:
Can I apply for a 2nd extension now? (about 1 year 4 months before my current visa expires?)
a) so that if I have a 3 yrs extension now, I will have a Tier 1 visa to cover me until I'm eligible to apply for Settlement Jun 2016.
b) I might need to change jobs and may not continue to earn as much as needed to be eligible for extension.
So can I apply for a 2nd extension significantly earlier?
I can just verbally tell them a reason if they ask but will they ask for a proof of why I'm applying earlier?
Thanks very much in advance for your replies!

You can apply early, and not required to submit any proof for early extension.

Fantastic, Thanks..

Other problem:
As far as I know, you can not apply for settlement more than 1 month before your existing visa expires. (source: https://www.gov.uk/settlement-refugee-o ... tion/apply )

So, lets say I apply for 2nd extension now, on Oct 2014, which will mean I'll have extension visa to cover for 3 yrs until Oct 2017.

Does that mean I cannot apply for Settlement when I will have completed 5 years in the country on June 2016? and will have to wait until Oct 2017?

If that's the case, when applying for 2nd extension, can I ask them to issue visa to cover until July 2016 only?

Thanks in advance!

No, that is not the case, it is alright to apply for settlement earlier as long as you have completed the 5 year period.

Hi All

Update - applied for Tier 1 extension 1 year 3 months early, at Croydon PEO on 17.09.2014.
No questions asked about early application at all. Application approved same day. Received BRP's today.
3 yrs extension granted from the date of decision till Sept 2017.

Good luck to all.

I think this is where you should be looking and not the link you have provided, https://www.gov.uk/settle-in-the-uk/y/y ... -1-general

unless you are applying as a refugee.
