Court hearing on regarding ILR instead of LR

I heard there is a court hearing already on british child parents should get ILR instead of LR 2.5 years (10 years route settlement). Does anyone know about this? Please share your views. Thank you.

Hi @amber! Both parents are overstayers, their children is british (born and brought up in uk for first ten years category), under the new rules, home office grant stay for 2.5 years (10 year route settlement). Someone challenge the home office they should get ILR instead of LR (2.5 years) 10 years route settlement. I heard somewhere already have a court hearing but no decision yet. Please could you comment on this? thank you.

Not that I know of but it's possible. There have been a number of challenges when it comes to a child's best interest when a child is granted limited leave to remain, but not so much adults.

Thanks@amber. Me and My partner lived in uk for 17 years and child british citizen (born and lived in uk for first 10 years category), we only got 2.5 years stay (10 years route settlement), no public fund. Even we not able to take child benefit for my british child. Is anything we can do for that? people saying there is a one court hearing like this case but decision not coming yet. Can we take child benefit for my british child?

Ct of Appeal is hearing 2 important appeals today (July 29, 2014) on entitlement of families with kids to ILR instead for 2.5 or 3 years DLR. Will update, Zane malik tweet it. Hope some good results coming soon.
