Tier 1 general - 2nd extension

Post by vennk0 » Fri Sep 26, 2014 7:23 pm

Hi,

Heard news that from 06-Apr-2015, Tier 1 general extension applications will not be accepted.

1. My first Tier-1 general was stamped on 16-Jul-2010 (for 2 years)
2. Applied for extension in 2012 and it is valid until Jul-2015

I was outside UK for more than 5 months due to personal reasons so not eligible for applying ILR.

So, can I apply for 2nd extension in June-2015. If so, what about news of not accepting after 06-Apr-2015.

Please advise. Thank you.

Hi Malik,

Sorry it was a typo, I stayed outside UK for more than 6 months. So, can I apply for extension (premium) in mid Feb-2015?

Thank you.

6 months is ok as long as you are able to split it between 2 consecutive 12 months.

For eg., 3 months in year 1 and 3 months in year 2.

Ok, let me clear out the duration. I was in India from Jan-2013 to Aug-2013 continuously due to some personal reasons.

I believe due to this I will not be able to apply for ILR.

So, looking for 2nd extension. My VISA expires in Jul-15 as mentioned earlier - by when can I apply for extension?

Thank you

I will be advisable for you to apply for 2nd extension on or before April 5, 2015, therefore yes you can apply in feb 2015. However, you will not be eligible for 5years continuos stay by April 5, 2018 being the last date for ILR on Tier 1 General visas. I think you can change to other Tier 1 categories in other to cover for the shortfall between April 5, 2018 and August 2018 so as to qualify for ILR.

Ok, so it is 8 months in total.

There is no restriction as to when you can apply for an extension. You can apply tomorrow or any day prior to 6th April 2015.

See pg. 19, in calculating continuous period for ILR (click).

I am not sure why second extension is needed.

If you can split 8 months between 2 years...and in one year if it is less than 180 days there should not be a problem.

My understanding is that you had one long absence of more than 180 days. It will reset your ILR continuous period starting from August 2013. ie. you will be ILR eligible in Aug 2018. Given Tier 1 related ILR is only there till Apr 2018, you may need to figure out a way to get on Tier 2 General before Tier 1 runs out. (All other categories will reset the period again.)

Cheers.
