ILR on 10 years basis

I want to apply for ILR on 10 years basis, during my stay one of my
visa being issued after I won the case from tribunal. And during
this process, which is almost took me a year ,I was in the UK , and
I think during this process you are legal to stay in UK. I just
want to know how will I show this information , and does this
period also include in my 10 years long residence period.
And also which visa I have to apply for my wife

guys i got question one my cousin been here for more than 9 years and 9 month and his last visa refused but and also his appeal refused at lower tribunal and upper tribunal now he put permission in upper tribunal to go to court of appeal..can he put request now to upper tribunal for change in circumstances or wait untill ten years complete he only got three months left..if they refuse his permission then he will go to coa direct and they might take more time??will this appeal process is cover by section 3c or nt..he got all his visas on time except this one..please reply and let us know wahts best for him??regards..

If the appeal has not been finally determined, withdrawn nor abandoned, then leave under Section 3C/3D is still ongoing.

i have same problem as you i came in last week of september 2003. .currently my appeal is in the court so if you can guide me what i have to do first:-
my Solicitor is saying the same thing but ...the questions are;-
1:- To withdraw appeal and then send a fresh application
or
2:- First to send a new application with CAS and then, when i receive acknowledgement letter then i have to withdraw appeal.
3:-Whats the procedure to withdraw the appeal and how long it takes.
4:-Do i need any letter for confirmation of withdrawal of appeal to send to home office with my application.

i think he has to go back for good.he may get better life back home, tel him to get max loan or credit card before going.
