Visa refused.how manydays i can stay legallywithout overstay

Hi everyone,

I need help in getting some information, Enterprenuer visa got refused.
time line:
applied on :18th july 14
refused on 18th sep 14 (received on 19th september 2014)
reasons for refusal:
1) no end date on contract
2) no business activity before july 11 2014.
i have few questions, please help me...!
1) say i want to leave, how many days i have got to leave before overstaying?
2) i have right to appeal, say i have appealed and appealed refused. then will i be considered as overstayer?
3) what is the best possible way to get out with out having bad immigration history?

im tired and exhausted with this process and no more strength to fight.

please provide answers...

Why do u actually want to do?

if u want to go no one is stoppig u call the number on refusal letter and tell them u want to go.

im not looking for 10 years. my enterprenuer visa got rejected on 18th sep 2014, i want to know my options to fight their decision and not having any bad immigration history like overstaying.

in the refusal letter it says " you have to leave immediately unless you are appealing or your appeal is unsucessfull". i tried calling UKBA, they said im overstayer by 3 days by now if im not appealing. if i appeal then ill be legal to stay.

but my question is, if my appeal is unsuccessful, will be overstayed again from the date of judge decision?
or do i get some time to wind up my things here and go back.

Im concerned about 1 year ban if overstayed.

You will become an overstayer when your time limit for appealing runs out and you don't appeal. You may be subject to a one-year ban if you overstay for more than 90 days.

i heard you can stay for 28 days to sort things and leave and it wont effect your future applications. is it right?

If u can't go within 10 days of refusal decision received. Than u will be in problem.

If u want extra time to pack up than lodge your appeal your previous leave will extend by virtue of section 3c until your appeal determine.

Meanwhile u can go any time

You are needlessly worried, just go for appeal . Chances of winning are always higher even you dont win from first court then you can go for higher court ..so so many time till then you are legal untill you apply within time limit.

My situation is almost same but i have not received any reply from home office ..lets see what happens.

@ Aravindv, send an appeal to the FTT and you will have an average of 3-6months or even more to prepare for your departure.

Since your application was refused based on not meeting the requirement for business to start before July 11, 2014 it might be very difficult to convince the judge to allow your appeal.

Once you send your appeal to FTT you can then leave the UK at anytime you wish before your appeal hearing without the need to withdraw the appeal as your appeal will be automatically withdrawn once you leave the UK. You will only need to call HO to arrange for your passport collection or pick up at airport on departure day.
