TIER 4 TO TIER 2 WITHDRAW

HI

one of my cousin passed masters degree from university of wales, his application is pending with Home Office for tier 4 extension further leave. One of the employer short listed him and ready to assign him certificate of sponsorship. but his application is pending with home office TIER 4.

shall he withdraw the application TIER 4 and send TIER 2 same day or something else he will do?

any helpful suggestion.

depends what your cousin wishes to do - if he wants to continue studying he should let his application run, if he prefers to work, after having been assigned the CoS but before the decision on his application is made he can vary it, no need to withdraw it.

if he withdraw the tier 4 application and submitted tier 2 application same day, is it allowed under the law?

complete the T2 grant of leave application form and send it to UKVI with a letter saying that he wants to vary his previous application. He only needs to enclose the difference in fees, if any, plus any additional documents that may be needed.

yes, it is allowed but if he withdraws his application, and assuming his T4 leave is no longer valid, he will become an overstayer and although he has 28 days to make another application if that application is refused for whatever reason he will not get a right to appeal.
